Phelps-Roper challenges flag law........

PAPILLION, Neb. — A judge set no timetable for his ruling after he accepted opposing arguments on Nebraska's flag-desecration law during a brief hearing Friday.

Shirley Phelps-Roper, of Topeka was charged with violating the law in 2007. She and her attorney, Bassel El-Kasaby, said the law violates her right to free speech.

They are appealing a county court ruling upholding the law.

Sarpy County District Judge William Zastera told El-Kasaby and the prosecutor Friday that he will review their arguments and rule later. The attorneys made no oral arguments.

Authorities say Phelps-Roper let her then-10-year-old son stand on an American flag at the funeral of a National Guardsman in Bellevue. They also say she wore a flag as a skirt that dragged on the ground.

Phelps-Roper, who didn't attend Friday's hearing, is a member of the Westboro Baptist Church of Topeka, whose members say U.S. troop deaths are punishment for the nation tolerating homosexuality.

She also faces charges of disturbing the peace, contributing to the delinquency of a minor and negligent child abuse stemming from the incident. El-Kasaby argues the application of those charges — not the charges alone — is unconstitutional because they stem from the flag-desecration charge.

Nebraska's law against flag desecration bars intentionally "casting contempt or ridicule" upon a flag by mutilating, defacing, defiling, burning or trampling it. Violating the law carries a misdemeanor charge.....

Prosecutors have argued the law prohibits only those five methods.

But El-Kasaby has argued those methods are open to interpretation and leave people confused about how they can legally protest using the flag.

El-Kasaby said he expects Zastera to affirm the county court's ruling, which would free him to take his arguments to the Nebraska Supreme Court.

"That's kind of what we want. This is the only way that allows us to go on with the appeal ... and appeal directly to the Nebraska Supreme Court," he said.

Freaky Freddie and the Westboro Dumbasses need to find nice quiet place to live that's far, far away from every other person Earth. I'm thinking that a mothballed oil tanker floating about 2 miles from the North Pole would be just about right.

,

My suggestion at the site was to send them to hate filled N.Korea.

And if not that because they don't allow new members enless they marry into the family take away the tax free rights as they are not a real church.

I don't like these weirdos either, but I think Nebraska's "flag desecrating law" is unconstitutional and outrageous. It flies in the face of our hard won freedoms.
Voltaire"s attitude as stated by a biographer was: "I disapprove of what you say, but I will defend to the death your right to say it."

That is the essence of what makes this country different and better than all the other countries past and present.

Many Countries Flag laws at Wikipedia

As much as I don't like it I and so many others fought are fighting for the rights of others to do just that. Yet I find it a shame our SC allows this when we have so many laws just to display the flag correctly

United States
The flag of the United States is sometimes symbolically burnt, often in protest of the policies of the American government, both within the country and abroad. The United States Supreme Court has ruled that, due to the First Amendment to the United States Constitution, it is unconstitutional for a government (whether federal, state, or municipality) to prohibit the desecration of a flag, due to its status as "symbolic speech."

Court won't hear funeral protest case

WASHINGTON — The Supreme Court has left in place a court order barring Missouri from enforcing a law limiting protests near funerals.

The justices refused without comment Monday to hear Missouri's appeal. The state enacted a law aimed at religious picketers who have turned up at soldiers' funerals. Members of the Westboro Baptist Church in Topeka, Kan., claim God allows soldiers to be killed as punishment for the nation's sins, including homosexuality, divorce and remarriage, idolatry and greed.

Church member Shirley Phelps-Roper persuaded the 8th U.S. Circuit Court of Appeals in St. Louis to issue an order barring enforcement of the law while a federal judge considers whether it is constitutional. They lost in another case with the same restriction, can't pay the cost ordered them to pay to the father of a fallen HERO and now using another situation will try to get off free

Phelpses mocked in Cohen film

THE ASSOCIATED PRESS
Sacha Baron Cohen, star of the new comedy film “Bruno,” jokes at the premiere of the film Thursday in Los Angeles. The movie has a segment poking fun at Westboro Baptist Church pickets.

No, Shirley Phelps-Roper won’t be seeing the new film, “Bruno.”

But she is in it.

She and a handful of other members from Westboro Baptist Church are among numerous recipients of satirist Sacha Baron Cohen’s mockery in his newest film that opens today, in which he takes on the self-made role of a gay Austrian fashion journalist named Bruno.

Baron Cohen’s movies are part documentary, part staged. In his last film, he played a Kazakhstani journalist named Borat. Because of the character’s naivety, he was able to cross the country, ingratiating himself to real people long enough for them to expose their biases.

Phelps-Roper, who often stands on an American flag during protests, saw “Borat” and remembers the scene of him butchering the national anthem in front of a rodeo crowd. “I just loved that,” she said.

Now she is the star. Or, more accurately, 21-year-old Jacob M. Phelps is.

It started on Palm Sunday in 2008. Baron-Cohen, dressed as Bruno, approached a Westboro Baptist picket at S.W. Gage and 19th. A Phelps child immediately recognized the actor/comedian, so the Phelpses played it cool. When Baron-Cohen wasn’t able to get a reaction from them, the movie’s producer called Phelps-Roper.

What can we do? Phelps-Roper remembers the producer asking.

“He hadn’t gotten anything,” Phelps-Roper said. “Since he’s all about mocking, then he wasn’t going to put any of our words in the movie, and we’re all about publishing.”

The church’s message that God’s wrath — in the form of U.S. troop deaths, commercial plane crashes or any other disaster — is the result of America’s acceptance of depravity. Namely, homosexuality.

Picketing on S.W. Gage days later, the confrontation materialized.

In Bruno’s preview for international audiences, Baron Cohen and another man are seen scantily dressed and creatively attached to one another while they charge through the picket line. As the two attached men approached Jacob M. Phelps, one of them reached out and grabbed his picket sign. When Phelps pulled back, the two let go and Phelps fell to the ground.

“So, of course that’s what they’re going to use,” Phelps-Roper said.

Asked why the church members would submit themselves to what they knew would be scorn, she said it was all part of God’s plan. God, after all, said that all true believers would be mocked, she said.

“We’re just going to have to take what it is and like it because that’s the way we do things,” she said.

Bruno is showing at Hollywood 14.

I do not support WBC for their pickets at soldiers funerals who got nothing to do with filthy sodomites. Here reverend Fred Phelps gone too far,and I am strongly agree with many and on their sides there. Those people deserve respect and honor. But I strongly agree with pastor Phelps in dealing with all GLBT perverts like picketing at gay funerals like Matthew Shepard and other gay or pro-gay events. Here WBC deserves some support, because as many other fundamental Protestant churches warns heathens that homosexuality is sin,Leviticus 18:22,and God is not mocked,Galatians 6:7.
