Republicans have voiced frustration with Obama's second-term "pen and phone" strategy of pursuing policy changes without Congress -- particularly environmental rules via the Environmental Protection Agency. Republicans also complained about numerous unilateral changes to the implementation of ObamaCare.

The lawsuit has not yet been filed. But asked Wednesday whether he intended to proceed, Boehner said: "I am."

"My view is the president has not faithfully executed the laws," he said. "What we have seen clearly over the last five years is an effort to erode the power of the Legislative Branch."

Other than the power of gridlock and vacations that would make a CEO blush, Congress isn't exactly using their powers as a legislature these days.

As far as this supposed lawsuit goes, I do wonder where guys like Boehner were during the last few administrations when the use of the executive pen was much more frequent.

I know, I'm told it's supposed to be quality over quantity, but where is the argument on quality? Can the overall use of executive orders of recent presidents be quantified into something that'll tell us what really abuse and what's just partisan complaining?

Congress cannot funcion because the Senatte will not consider legilation sent over from the house. It would seem more important issues, such as renaming the Redskins, are taking up their time at Harry Reids royal court.

This is, in fact, what the Founders intended when they made it cumbersome and difficult for those entrusted with power, to excercise that power over the people.

This is how it should be. Especialy if you consider that at some point, we ought to have more than enough "laws" on the books.

The issue of performance in Washington is not the Congress, it is the Executive, which is not exercising it's authority under the limits placed upon it by the covenant of our nation. Our contitution clearly limits the office of the President to tasks of administration, not legislation and regulation.

Mr Obama has a different view on the matter. As Thomas Sewwel has suggested, Obama's exercise of power outside the Constitutional limits makes him the power. He is not a Lame Duck President, because he has fundimentaly altered his office,,,,and therefore the nation.

And we are now a Lame Duck Country.

you knew it was coming especially after his second term win. Hungry for the power they used to wield, they'll stop at nothing to get it back. God help this country. Republicans have turned it to pure sh*t.

While obviously there should be checks to power, this Congress in recent years has been incredibly unproductive and ripe in gridlock, and I think even beyond what the founders intended when they wanted a slow, deliberative process to legislation. We can barely even pass a budget these days, much less pass meaningful tax and immigration reform. This is basic stuff here, and we can't even get that done without running it through the world's longest, continually jamming meat grinder. Even when we had that short stint of filibuster-proof Democratic rule in the House, Senate, and Presidency, they really didn't do a whole lot with it.

Agreed. Unfortunately, most of the lack of legislative advancement can only be laid at Sen, Reid's feet. The house passed the budgets, and the bills. Reid refused to bring them up. Even bringing them up to have them defeated would have been some progress, but not even bringing them up was, and is, a dereliction of his duty and an abuse of office by Reid.

The lawsuit, though, is a separate issue. It claims abuse of office by Obama because of his changing passed legislation by presidential fiat. While I agree that the Senate has totally failed to do the job it is supposed to do, that doesn't hand dictatorial power to a president irregardless of his politics.
