Default No charges for murder

https://www.msn.com/en-us/news/crime...qYY?ocid=ientp

I guess now you can murder without consequences.

Pennsylvania state troopers Branden Sisca and Martin Mack had pulled Webb over in Philadelphia on I-95 North near Allegheny Avenue for dangerous driving.

They gave Webb a warning and got off I-95 North, then back on I-95 South, responding to another call about a man in the left lane near the sports complex in South Philadelphia.

Apparently, Webb also did the same. State police say that around 1 a.m., March 21, as Mack and Sisca were helping Reyes Oliveras, 28, from Allentown into their cruiser, Webb came onto the left shoulder between the barrier and the left lanes of traffic and hit all three men, killing them.

Pennsylvania State Police say Webb was speeding at the time, and her blood alcohol level was twice the legal limit at the time

What I don't understand is why they let her keep driving while under the influence, she followed them and purposely ran them over after
they let her go. I would think that would be at least 2nd degree murder.

A person here in Texas caused the death of another person because of drunken driving. The charge was first degree murder. I don't remember the details. This was more than a year ago.

1st degree murder means the murder was premeditated. I don't see that charge sticking to a drunk driving case. Involuntary manslaughter would be the appropriate charge.

They are charging her with vehicular manslaughter...

...but getting off of the highway exit, making a turn to get back on the highway through an entrance, and THEN aiming for those officers sounds pretty meditated to me...

That would be first degree murder. The defense argues that she was not aiming for the officers. She was drunk. Because there was a man walking down the middle of the highway that police were trying to get off the road (it was the call about this man that cause the police to leave their traffic stop with her, otherwise she probably would have failed a field sobriety test and gone for a ride in the back of their cruiser), traffic was backed up.

She couldn't be bothered to wait for the traffic to clear out so she went around the traffic on the shoulder hitting the three men.

At least that's the claim.

Now it very well could have been premeditated and retaliatory which would be 1st degree murder, but that would be hard to prove.

Quote:
Third degree murder is the catch all for other murder offenses not falling into the first two categories. This is a felony and has a punishment of between 10 and 20 years of prison time. An example of facts in a third degree murder are when someone shoots another person and kills that person without intent or when not in the course of a felony.

Quote:
Murder of the third degree is a felony of the first degree.” Third degree murder is punishable by a prison sentence of 10-20 years. Killing someone without premeditation or without intention is third degree murder, so long as it was not done while committing a felony (second degree murder).
If she had a blood alcohol level of higher than 0.16 or she was driving under the influence after being convicted 2 or more times of a DUI, she was committing a felony DUI.

So there is that. But 3rd degree murder does not require premeditation or intent, it does require malice. Personally, I feel they cleared that bar easily and possibly the bar for second degree murder. If retaliation or intent could be shown then 1st degree murder. Tell you what give all of them to a jury. 1st on down to involuntary manslaughter and let them decide which she is guilty of!

I think you misunderstood me. Racism is why the judge dismissed the murder charge against her.

Edit: As in the judge gave special treatment to the girl because of her race weighed against the race of her victims.

Yeah it sure sounds premeditated. But her defense will say it's just a coincidence that she made a U turn and followed the cops that should have arrested her, then accidentally steered the car at them and ran them over.

A couple years ago one of my drivers was hit in an intersection by a young black gal that ran the stop sign. My guy was in a flatbed delivery truck and you could tell she was going pretty fast and missed the sign, otherwise she would have had to floor it from the stop sign to make that much damage in 10-15 feet. Anyway, my driver called and said she was going off on everyone, even the cops, she was also playing the race card big time.

She was so loud and belligerent that the cop did not cite her for some reason, he didn't cite my guy either. On top of it my driver found out her name and went on Facebook and found a post and picture of her driving at the exact same time as the accident, we told our insurance company but they still paid her off and my insurance went up.

I truly believe she got away with it because she was black and very obnoxious.
