Default California judge again blocks Trump administration's new asylum rule nationwide

One of the favorite weapons of the Resistance in their campaign to undermine the Trump administration and overturn the results of the 2016 election is inducing hand picked Federal judges mostly in the 9th circuit to issue nationwide injunctions blocking rule changes and executive orders. Appeals to the judges overreach must first be submitted to the ultra liberal 9th circuit court of appeals.

Leftwing open border advocates applied this technique to block the Trump administration from changing the rules for asylum application to require migrants to apply in the first safe country they cross in their journey. This conforms to the UN standard. Predictably Resistance Democrat groups were successful getting an Obama appointed, San Francisco based judge to issue a nation wide injunction barring implementation.

Quote:
A federal judge in California reimposed a nationwide injunction blocking the Trump administration from enforcing severe new rules for migrants seeking asylum at the southern border, a setback for the president as he seeks to crack down on illegal immigration.

The Monday ruling from U.S. District Judge Jon Tigar blocking the restrictions nationwide for a second time comes after the 9th U.S. Circuit Court of Appeals last month narrowed the scope of the injunction to apply only within the circuit, which includes the border states of California and Arizona. As a result of the 9th Circuit's order, the asylum policy could take effect in Texas and New Mexico.
Not even the 9th circuit court of appeals could dissuade the imperial judge from imposing his will to supersede the duly elected President. Just another example of the ends justify the means for the Resistance.

I was confused for a sec...I was thinking, "Didn't a higher court just overrule him?...And he's doing it AGAIN???"...

Sadly, the answer is "yes"...

But the Supreme Court JUST intervened and laid the smacketh down...

Supreme Court Reinstates Trump Administration Asylum Restriction

Quote:
The U.S. Supreme Court Wednesday reinstated a new rule by the administration of President Donald Trump that prevents almost all migrants from Central America from applying for asylum.

The high court suspended a preliminary injunction issued by U.S. District Judge Jon Tigar of Oakland that would have blocked the rule during proceedings on a lawsuit challenging the measure.

The lawsuit was filed by the Berkeley-based East Bay Sanctuary Covenant and three other refugee assistance groups.

The rule bars migrants who have passed through another country en route to the southern U.S. border from seeking asylum unless they have asked for and been denied asylum in the transit country.
The first sentence of this article is VERY misleading...

It SHOULD read "prevents almost all migrants from Central America from applying for asylum ON US SOIL WITHOUT APPLYING FOR US ASYLUM IN A COUNTRY THEY'RE GOING THROUGH TO GET TO THE US FIRST"...

The migrants have to apply for and be rejected for asylum in a country they cross on their journey. For the migrants from Central American countries this means at least Mexico which has offered residence and work permits. Of course the so-called caravans are organized based on the promise of entry to the US.

As bad as the abuse of our asylum laws has been the more troubling problem lies with corrupt Federal district judges issuing nationwide injunctions. The notion that any political appointee in a black robe can second guess the duly elected President accross the nation on service to their political beliefs is toxic to the Republic. The SCOTUS acts as a super legislature with authority to amend the Constitution at will so why shouldn't district level judges do the same with executive actions. After all we live under a judicial oligarchy don't we?
