For those who don't think about our 4th Amendment Rights, and 'signed away' their expectations to have a bit of fun with 23 and Me or whatever it's called, this is the out come.....

While in this particular case, it may have found a killer, it may not always be so straight forward and clear.

23 and me isn't the company that the police used. GEDmatch was. Sorry, just being technical.

That being said, this is more concerning to me, "they waited for him to discard items and swabbed them for DNA". No court warrant was used for that.
Is it legal for the police to sift through my garbage? 4th amendment may be a valid argument for his defense.

Yes it is. From what I understand, you are essentially putting your garbage into the "public domain" as you are indiscriminately putting it where potentially anyone could access it. And as the police are "anyone", there is no legal expectation of privacy.

I used 23 and Me as an example, there are any number of those type of companies out there, but the article I had originally read didn't specify which company gave it up.
