Franc you can keep coming to the defense of this foolishness but those who end up with the bad water are the minors who live downstream. You are just looking for excuses for corporations out of political partisanship. The rule is very simple and reasonable. Checking the water before, during or after mining operations. Anyone who could be against that is ignorant.

Oh good, you understand gravity.

You keep insisting this is about BAD water. It is not. It's about whether on not the EPA can walk into your back yard after a rainstorm and then tell you that you are in violation of their proglumated standards.

The EPA did not have to prove the ruling was legal or justified, or even that you were in fact, under their control. Instead, you have to prove them wrong. In court. Your Constitutional right of redress is by-passed.

Back in the 1970's I was a compliance officer for a large printing company. Back then, the EPA followed the laws constructed by our Congress. Navigable water was considered anything that was permanent and could float a boat. Today, they just make them as they go. And so now they have extended their reach far beyond the original scope by declaring power over anything that is wet.

If this is a necessary control, it should be enacted by the legislature, not some party affiliated appointed bureaucrat with an agenda. It is not about whether or not we should have clean air and water. That is a given. it is about who has the authority to get that done.

Let us remember that it was bureaucrats and politicians that let Flint Michigan drink polluted water. And it was the EPA that turned an Animas river in Colorado orange.

Actually, the Constitution is mostly about what cannot be done by the government.

Regulations that take people's property rights, without due process, is one of those things. It is, in fact, key to your personal freedom.

This has nothing to do with taking anyones land. WTF is wrong with you? They wanted the water checked. That is bad why?
