That may depend.
If the curriculum is too difficult for somebody with lower SAT's to accomplish success, it may just be setting a standard.
Now, if an institution allows a lower SAT for certain races, that is discrimination that sets somebody up for failure as they will be competing against people that obviously test better than they do.

Smart may have nothing to do with it - I might be just more disciplined and work harder with less

Are you referring to affirmative action? If so...my thoughts are this:

Affirmative action was needed at one time. Many jobs and schools subtly barred entry to minorities and women. Afirmative action forced them to remove that bar. My great aunt was refused admittence to a business degree program because she was a woman; my aunt had to fight to get a PhD in chemistry, as a woman. My mother faced similar discrimmination in her field of epidemiology. None of them benifited from affirmative action, it wasn't there at the time. But I can certainly see the reason for it.

I think that reason is past now, and it's time to dismantle it.

It's discrimmination no matter what. You are discrimminating by making a choice based on specific factors - that doesn't mean discrimmination is bad - it's a fact of life.

I really wasn't thinking about affirmative action when starting out this thread, to be honest I had not thought about it until Pat mentioned it. I was more wondering if regular people discriminate and then I wondered are there circumstances where people accept a discrimination as ok and therefore its still legal to do. But then Pat mentioned that and I remembered that also is a form of legal discrimination. I was just making a spontaneous thread.

Every decision made involves some sort of discrimmination doesn't it?
