Actually we are talking about a change in the Constitution for this one.

I bet they considered that name but just knew how short thinking many are and figured they wouldn't even give it a chance if it was a NEW tax.
I still don't think that we MUST make changes on the local and state systems to enact a new federal system.

I don't think it would be possible anyway. Some states(like Fla) don't overtax their residents and have fairly simple tax structures.

If you go back to the first post in this thread, you will see the copies of the legislation we are debating... the house version and the senate version.

The organizer's are saying that the Amendment(was it the 16th) that made the income tax possible must be rescinded in order NOT to let the politicians after getting the NEW tax stick us with the old one too.
I tend to agree cause we all know how politicians work. It is only the constitution that protects us from them.

It is noted:
----------------------------------------------------------
(d) Liability for Tax-

(1) IN GENERAL- The person using or consuming taxable property or services in the United States is liable for the tax imposed by this section, except as provided in paragraph (2) of this subsection.

(2) EXCEPTION WHERE TAX PAID TO SELLER- A person using or consuming a taxable property or service in the United States is not liable for the tax imposed by this section if the person pays the tax to a person selling the taxable property or service and receives from such person a purchaser's receipt within the meaning of section 510.
----------------------------------------------------------

Government was never granted the power to lay a direct tax upon the inhabitants of the States. I don't know why this Fair Tax couldn't be an excise tax like the federal income tax is now. The tax could be imposed on business, with the amount of the sales being the measurement for the amount of the tax owed. Little wonder this legislation isn't getting anywhere. It's WAY too complicated.

The Supreme Court has noted that the government always had the power to impose the "income tax"; that it is an excise tax, a power granted the federal government by the States.

I OFTEN WONDER WHETHER WE DO NOT REST OUR HOPES TOO MUCH UPON CONSTITUTION, UPON LAWS AND COURTS. THESE ARE FALSE HOPES, BELIEVE ME, THESE ARE FALSE HOPES. LIBERTY LIES IN THE HEARTS OF MEN AND WOMEN; WHEN IT DIES THERE, NO CONSTITUTION, NO LAW, NO COURT CAN EVEN DO MUCH TO HELP IT. WHILE IT LIES THERE IT NEEDS NO CONSTITUTION, NO LAW, NO COURT TO SAVE IT. — Judge Learned Hand
