I truly don't know that for sure. And that's all I'll say about that.
I think singling out the same sin for tax each and every time you want to add a pool to your neighborhood (figure of speech) is outrageous. There will come a day when soda and chips are excessively taxed. Mark my words.

This is a tourist tax, for the most part.
Any time you tax a vice you end up creating more crime. Tourists stuck in Manhattan will pay the extra fee, everyone else will pay 1/2 price on the black market or in a neighboring state. It sounds good but I bet it ends up revenue neutral. Everyone already knows to carry enough cigs with you to not have to waste your money buying them once you get to New York. Once they stop me from carrying any into the city when I fly in for two days, because they order a search and seizure at the airport, then we have a problem...
