I'm all for free speech but always thought it should be illegal to burn the American flag. I'm all for this, though think Republicans could concentrate on more important issues currently facing us.

Republicans propose constitutional amendment to outlaw flag burning President Trump endorses it

President Donald Trump is supporting a proposed constitutional amendment that would outlaw American flag desecration.

What are the details?

Rep. Steve Womack (R-Ark.) and Sen. Steve Daines (R-Mont.) introduced a constitutional amendment on Friday that would give Congress the authority to ban flag burning.

"The Congress shall have power to prohibit the physical desecration of the flag of the United States," the proposed amendment states.

While flag burning is frowned upon, it is not currently illegal to destroy Old Glory. The Supreme Court ruled in the landmark 1989 case Texas v. Johnson that flag burning is a form of free speech protected by the First Amendment.

The ruling made it unconstitutional for local, state, or the federal government to prohibit flag burning.

"Our flag is more than a cloth painted red, white, and blue. It is a symbol of worldwide freedom, unity, and liberty," Womack said. "Generations have fought to defend our stars and stripes and the American people have simply given too much for the flag to not have the ability to protect it."

"Our United States flag is a timeless symbol of liberty that tells the story of America, the story of our enduring pursuit of freedom. Remembering the sacrifices of all who carried its colors into battle, our nation should always render the flag the honor and dignity it is due," Danies said.

What did President Trump say?

Trump said Saturday that the amendment is a "no brainer."

Trump has previously endorsed severe consequences for those guilty of desecrating the American flag. Trump, then-president-elect, said in November 2016 that consequences for flag burning should include prison time and, perhaps, the loss of citizenship.

Trump's right, it's a no-brainer.

Every time this has come up for a vote, an amendment to ban flag burning has failed to pass. It requires a 2/3rds vote in the House and Senate, surely there are enough Democrats and Republicans that value free speech enough to oppose it again. Came close in 2006, lost by one vote in the Senate, and surprisingly one of the three Republican no votes was Mitch McConnell. Guess he used to be useful for something.

This is nothing more than some meaningless red meat for the base. There are zero good reasons to make it illegal, and plenty of bad reasons to do so.

He and they should get back to failing at immigration and not giving a sh-t about the deficit.

You little chicken shlt cowards want the right to burn the flag so badly, it gives you diaper rash. I served this nation for 20 years to help guarantee you craven sissies the right to be ass holes, if you felt like doing it. If it makes you feel important to set a symbol on fire, I strongly suggest you do it in front of a group of Veteran bikers, to show them you are just as tough as they are.

I removed the last sentence of your post (only in this response) and
agree with everything else above...

First, there are bigger fish to fry...This, definitely, is a red meat issue...No one has been wringing their hands over this, and no one has been sweating bullets praying this doesn't happen...

Secondly, AS LONG AS the flag is their personal property, and burning it doesn't endanger others, I have no LEGAL problem with it..

Besides, this can happen, which is never a bad thing...


The people around him are equally stupid...They tried to put the fire out on him and not the flag...Should've been the other way around...

not so sure we need a specific law or amendment to outlaw burning the flag.
flag burning tends to be a public event and isn’t it already illegal to start fires in public?
heck it’s illegal to burn trash and leaves within most city limits and isn’t that where these public displays that involve flag burning usually take place - inside city limits?
again, probably already illegal to start a fire in public within city limits.

I find flag burning in protest deeply deeply deeply offensive.

But it shouldn't be illegal.

If it isn't your flag, then yeah you should go to jail.
If you are starting fires on another person's property or public property without permission, you should go to jail.
If you are inciting a riot, you should go to jail.

But as offensive as it is, if you want to do something as stupid and offensive as burning a flag in protest, you should be allowed to do so.

Note: Burning of a flag is listed as one of the ways to properly dispose of a flag.

I heard someone on TV this morning stating that it would be a simple, single sentence amendment to the Constitution stating that desecrating a flag would be illegal. That presents many problems that could be used to target those with which the those in power may use against them. If someone had a paper plate with the image of the flag on it, would it have to be preserved? What about a shirt with the flag imprinted on it?

This is nothing but silly legislation meant to rile up people eager to show their patriotism. I too detest idiots that stand in the street burning the American Flag. But if they are breaking no laws and are burning their own flag, that is their right. However, watching them catch themselves on fire in the process is good entertainment.

America would turn into a country like those Muslim countries that forbid desecrating any symbol containing the Koran or words from it.
