A southwest Missouri couple who illegally bought ginseng from Arkansas has been sentenced to a year of probation.

The Springfield News-Leader reports 77-year-old Kermit Schofield and his wife, 73-year-old Sandy Schofield were sentenced Tuesday in a courtroom packed with supporters from their hometown.

The couple farms and sells herbs in Theodosia, a town of about 250 people near the Missouri-Arkansas border.

Federal prosecutors say that between June 2013 and August 2015 the Schofields illegally bought more than 100 pounds of ginseng in Arkansas. Prosecutors say the couple bought the ginseng outside the permitted time frame for purchasing ginseng in Missouri, and they knew it was illegal transport ginseng out of Arkansas without a state certification.

As part of the sentence, the Schofield's agreed to pay $65,000 in restitution and a $5,000 fine.
The FBI goes after old people and their ginseng now.

The old FBI days of guts and backbone are gone. Seems to be the FBI is the finest law enforcement institution that money can buy. My opinion.

No...I agree with the ruling...

1) Ginseng is HIGHLY valuable...That 100+ pounds they brought illegally?...Sometimes it goes for $600 for ONE POUND...

2) There are restrictions for when it can be harvested and sold because it's so rare you don't want to over-harvest and find the root extinct (Much like bluefin tuna and many other species)...Purchasing across state lines was also a known restriction...

3) They knew it was illegal...This wasn't a one-time whoopsie or an Uncle Leo moment where they were confused...They were in that business for years and the time frame for their illegal activity was over three years...

2) 1 year probation...As Joe Biden would say, "Big f'in deal"...I would be on board with ya if they were thrown in the slammer, but this is more procedural...Prosecutors wanted this on the record both as a first offense if the elderly couple gets caught again, and to increase the numbers of successful convictions as a warning to others...

The fact that granny and grampy managed to cough up $70,000 tends to make your point
