Thumbs up Judge Rules With Trump, States Have Power To Punish Sanctuary Cities

This is not only a win for Trump, but a win for US citizens.

In a 3-0 decision by the Fifth Circuit Court of Appeals, the new Texas law SB4, which imposes sanctions on cities within Texas that implement sanctuary city policies, has been upheld.

The ruling marks a major victory for President Trump, who has been pursuing ways to force sanctuary cities into compliance with federal law and their cooperation with Immigration and Customs Enforcement (ICE).

The judges decided that the detainer requests issued by ICE are legitimate. This means that local authorities must work with requests, but with one caveat. Cities can refuse to cooperate if they deem they do not have the resources needed to comply.

ICE often requests that local authorities hold illegal immigrants, that are set to be released from local jails and prisons, for ICE to come pick them up and process them for deportation.

When illegal aliens are transferred into the custody of ICE by local authorities, it saves them immense resources and spares them from the dangers of tracking the criminals down on the street.

Several cities and even entire states, such as California, have implemented policies against law enforcement cooperating with ICE in most instances.

Regions with sanctuary policies release the vast majority of their illegal alien inmates onto the citizens so they can continue to perpetrate crime in the country.

SB4 mandates that local jurisdictions in Texas comply with federal immigration authorities when they make detainer request. Forcing places with large populations of illegal immigrants such as Houston, Texas into compliance will help cull criminals from the population of illegal invaders.

Sanctuary cities also have policies against law enforcement inquiring about the legal status of people they encounter while on the job. When police are responding to a call or making an arrest in regions with sanctuary policies, they are not allowed to ask the perpetrator if they are a United States citizen.

SB4 requires that law enforcement inquire into the legal status of individuals they encounter. This simple provision in the law will help document the pervasive criminality of illegal aliens in the United States.

Judge Edith H. Jones wrote in the courtís opinion that the Fourth Amendment may not be applicable to illegal aliens. The court also determined that the ICE detainers are enough probable cause to hold the illegal aliens in custody.
