Angry Convicted sex offender Brock Turner wants new trial in Stanford sex assault case

Quote:
A former Stanford swimmer convicted of sexually assaulting an unconscious woman outside a campus fraternity party is appealing.

Lawyers for Brock Turner filed an appeal Friday. They argued the Ohio native’s initial trial was “a detailed and lengthy set of lies.”

The attorneys say they hope a new trial will help overturn Turner’s mandatory lifetime requirement to register as a sex offender.

The case gained national attention when Judge Aaron Persky sentenced Turner to six months in jail.

NBC Bay Area reported that John Tompkins, Turner’s legal adviser, said what happened wasn’t a crime. Tompkins says the facts don’t reflect the verdict, and that’s why they’re appealing.

Key to Turner's request for a new trial is a statement the prosecutor repeatedly made during trial, saying the assault occurred "behind the dumpster."
The assault, Turner's lawyers argue, did not occur "behind the dumpster." Indeed, the victim was found in a "completely open setting," the appeal states, adding that the implication that the crime occurred "behind the dumpster" prejudiced the jury against Turner.
That characterization of the crime, "implied an intent on the appellant's part to shield and sequester his activities" and "implied moral depravity, callousness and culpability on the appellant's part because of the inherent connotations of filth, garbage, detritus and criminal activity frequently associated with dumpsters," the document states.
The appeal also claims Turner was denied a fair trial because witnesses who would testify to his good character were excluded by the court. It also claims the prosecution failed "to present constitutionally sufficient evidence" to support the three counts of conviction.
Turner's lawyer, Eric Multhaup, said he had nothing to add about "the unfairness of the conviction" beyond the court filing.
"What we are saying is that what happened is not a crime," John Tompkins, Turner's legal adviser, told KNTV. "It happened, but it was not anywhere close to a crime."

Sounds like the family doesn't understand the definition of rape.
Makes me wonder if their lawyer understands, or if maybe he is doing this for the family's paycheck and for the notoriety...

He has acknowledged that some sort of sexual assault took place. Arguing semantics when the event was being described, might as well ask him what adjectives he would use. I believe most attorneys will use the most shocking and repulsive terms possible, in order to paint the horror of the event.

In this particular circumstance, I think they went easy. If such a thing were to happen to him in jail, exactly what adjectives would he use??

That piece of vermin got off much too easily. The "punishment" he received does NOT fit the seriousness of the crime. It doesn't matter if the rape occurred behind a dumpster or not; the fact that it happened is what matters. The claim that the trial was unfair because "witnesses who would testify to his good character were excluded by the court" is ridiculous in the face of this terrible assault against the girl. Males of good character don't have sex with unconscious females, period.

I hope that he DOES get a new trial.

I mean that would mean he could get a new sentence, right?

So here's the thing... He's demanding a new trial because he WANTS a new sentence.

Basically one that DOESN'T include having to register as a sex offender.

This (When Double Jeopardy Protection Ends - FindLaw_) articles says:

Quote:
Defendants who appeal their conviction assume the risk that a harsher sentence will be imposed during re-prosecution.
However, I found other sources that indicate this is wrong and other sources that indicate those sources aren't correct either.

So I don't know what the truth is.

As easy as this rapist got off, he's showing a special kind of stupid to challenge the legal judgement he ended up with that didn't throw him in prison for 10+ years.

To my understanding, for a person in prison, parole hearings often talk about the crime involved and whether or not the person is repentant. These factors are evaluated regarding the question as to grant parole.

I don't think there is any "reverse" mechanism whereby a person like Brock who is out free is recognized as having gotten off light because he refuses to show remorse or even comprehend what he did was wrong.
Articles like this make me think there should be...
