If collusion to split legal fees on a civil case that was, in fact, invalid, it would probably change to a criminal case of fraud, subjecting all parties to prosecution, and potential jail time. Not exactly the type of conspiracy theory one would imagine anybody would think up, particularly when the case is frivolous, and will probably get thrown out of court. After all, it happened in Georgia, and the culprit was African-American. If you have ever worked in retail, restaurant, stadium's, etc., you know that these type of cases, frivolous lawsuits occur all of the time. Slips, falls, insults, false arrest on shoplifting, occur daily in just about every establishment. It has to be real serious for the establishment's insurance company and lawyers to go to court. In most cases, these things are paid off at $2,000 just to get them out of the way. Not exactly a windfall for a scribbled line on a valet parking card, where the prosecution (in most cases heard only by a judge, not a jury), must prove guilt by a preponderance of the evidence (51% only), unlike criminal court, where guilt must be proven beyond a reasonable doubt. Much higher standard. Since the guy won't have to testify, and if he does, he could simply state it was a "joke" I doubt this goes any further than a 20-minute discussion in a civil court before being thrown out, if it gets that far. Besides, the case is against the valet company, not the restaurant, which has already provided for compensation to the couple. Lawyers "hammer" out advertisements daily on television and radio, screaming for lawsuits against companies for this type of stuff - rarely do they get a penny, but they do make money from the clients thinking big riches are coming their way. Dump lawsuit, dumb people, you can forget all about this one......STFAN
