But you and I know that these are only a few examples of the prolific spread of sexually transmitted diseases. We KNOW of a means that will permit the industry to continue to operate and INCREASE safety for the workers, but we're unwilling to regulate that? That doesn't make much sense. We're willing to regulate the requirement of other safety precautions across all of industry. There is no reason why porn should be treated like the bastard stepchild.

There are actors infected with HIV that still perform and the production companies just have the other performs sign a waiver of knowing. What?!

I agree. I see it as a matter were OSHA standards should apply.
I never claimed anyone had a "right" to work in adult entertainment, any more than I would claim anyone has a "right" to work in construction... one must possess certain qualifications to work in either industry.
But one does have a right to work in any legal occupation as safely as possible, and not be pressured by employers to wire back the safety on one's nail gun, work on a roof without a safety harness, or work in adult film without a condom. Yes, even in non-union states. That is why OSHA is federal, and so-called "right to work" states (oh, the irony) can't get rid of OSHA standards even though they'd like to.

According to your article, there have been 9 instances in 7 years. That's pretty goddamn low.

What he's saying is that by trade, he and I both do our best to expect the unexpected. That just because someone is supposed to perform a task in x,y,z order doesn't mean they will. And just because we hope and trust that people will do a, b, c doesn't mean they will. And that actually goes for just about anything... from software development to teaching scuba diving. but in the case of scuba diving, something stupid my student does wrong could cost their lives. People don't always do what they're supposed to do, or what you trust they will do.

Just a fact of life.

Trust is a risk. Period. If it not a risk, then it's not trust.
If there's no risk, then it's a simple ackowlegement of fact, not trust. I've known a lot of people in my life who have gotten divorced and were completely blind-sided when they were told that their partner had cheated on them. They thought that everything was great and that there was no way their husband/wife would ever do what they were doing. They had complete trust in the other. Never assume that things are perfect or that you know everything that's going on, because that's where the real pain begins. I trust my wife, but I also know that there is a vanishingly thin chance that she has a boyfriend on the side. I'm not going out and following her around to see if she does, because I trust her and have chosen to accept that the chance of her having a boyfriend is vastly less then the chance that she is completely faithful.

Both are oriented around the issue of trust vs. risk.

It's the porn industry for crying out load. There are some risks involved there just like any other profession and no amount of laws can prevent that or bring the risk to zero.
