Njoku signed up to have the rebate deposited directly into his Chase Bank account. But when the IRS rebate arrived, there was a problem. Chase had closed Njoku’s account because of overdrawn checks in the past. The bank deducted $600 to cover what he owed them and mailed him a cashier’s check for the difference--$8,463.21.

But when Njoku showed up at the Chase branch near his house intending to cash the check, he was in for a nasty surprise.

The check had Njoku’s name and address on it and was issued by JP Morgan Chase. But the Chase Customer Banker who handles large checks at the Auburn branch was immediately suspicious.

“I was embarrassed,” Njoku said. “She asked me what I did for a living. Asked me where I got the check from, looked me up and down—like ‘you just bought a house in Auburn, really?’ She didn’t believe that,” he said.

The Customer Banker said the check looked fake, so she took it, along with Njoku’s driver license and credit card, and called Bank Support.

After waiting for about 15 minutes, Njoku said he got impatient and told Chase he was leaving to do an important errand. By the time he got back, the bank was closed. Njoku said he called customer service and asked them what he should do. He says they told him to go back to the bank the next day to get his money.

But when Njoku arrived, it wasn’t the money that was waiting for him.

They just threw me in jail; they called the police and said this guy has a fraudulent check,” Njoku said.

Auburn police arrested him for forgery - a felony crime.

“I was like - you’re making a mistake, you’re making a mistake, don’t take me to jail, I got work tomorrow. I can’t afford to miss work,” he said.

Njoku was taken to jail on June 24, 2010, which was a Thursday. The next day, Chase Special Investigations, realized it was a mistake. The check was legitimate. The Investigator called Auburn Police and left a message with the detective handling the case, but it was her day off. So Njoku stayed in jail for the entire weekend. Finally, on Monday, he was released.

Auburn Police Commander Dave Colglazier said Chase could have done a lot more to let them know they’d locked up an innocent man.

“We do have a main line that comes into our front office,” he said. “There are ways to reach someone 24/7 at a police department.”

For Njoku, going to jail for five days
meant a lot more than just losing his freedom. He said the entire time he was “just stressed out…trying to figure out what was going on with my vehicle. I love my vehicle,” he said.

Njoku’s car had been towed from the bank parking lot and his check seized as evidence.

“I had to wait a couple of weeks,” he said, “and my car got sold, auctioned off."

Njoku says he didn’t have the money to pay the impound fees and fines to get his car back before it was sold. He said he also lost his job because he didn’t show up for work while he was in jail.

After all of that, Njoku said he never heard a word from Chase.

“They haven’t even sent me a letter or apologized,” he said. “It’s been a year we’ve been trying to contact these guys.”

This story is like a train wreck that kept getting worse.

Njoku got a lawyer.
SURPRISE! Chase is suddenly talking since he lawyered up and claiming they are looking to get a fair resolution to the issue.

Chase did not even realize THEIR OWN CHECK was real, were directly responsible for him being in jail for five days, him losing his job and his car.
I hope he takes them to the cleaners.
I'm not talking "millions", but it is downright despicable that Chase would not do right by this guy until they were threatened with a lawsuit.

Agreed...Chase owns him for damages and a good five figure punitive charge...

As a side note, I'd like to say that Njoku can now search his name and see I said he's good guy if he'd like to share...

I did business with Chase once. That was enough. I honestly could not cash a Chase mortgage check at a Chase bank. Swear to god.

Ths action (or rather, inaction) by Chase is indeed despicable. If it will not settle out of court, it deserves to become the recipient of a lawsuit.

Something smells funny here. Maybe it's me. (Taco Bell for lunch) But without researching this story a millisecond, I just smell tabloid (News of the World) media.

Give it a day and will capitulate if wrong.

I don't put it past Chase at all. I was sort of forced to bank with them when they bought out my old bank, Washington Mutual. WAMU was an excellent bank so I was sort of complacent when Chase bought them...kinda figured it couldn't be that big of a change.

Screw that. It's like they wanted to get rid of all the WAMU customers. They held a direct deposit of mine for 7 days once. Same one that went in every two weeks for two years prior. They also just cancelled my debit card once. When I called them, they said it was because it was used at stores that weren't typically used...and by that, they meant outlet stores that were about 20 miles away from my home. Yet, two weeks before they allowed a fraudulent charge on my card for a plane ticket bought out of somewhere in Mexico. Took them 4 weeks to refund the charges back to me.

When I went in to take all my money out, suddenly then they became all apologetic and when I still insisted that I wanted a cashier's check for the balance of my matured CD's, savings, christmas fund, and checking...they decided that they needed to hold the cashier's check for the balance for 10 business days to make sure there were no outstanding transactions on the account. Their reason? Because there had been a few a few irregular account activities, referring to the fraudulent charge in Mexico and the closed debit card for irregular transactions 20 miles from my home.

**** Chase. When I did get my money back from them, I stuck it all in a Capital One interest checking account, bought CD's with them and have been happy ever since. And since I have my credit cards with them, too, they increase the credit lines on them about every 3-5 months which looks really good when I actually make a credit purchase like a car or a house.

BB&T is another bank, along with Chase, that I avoid like the plague.

BB&T will charge $5 to cash a check DRAWN on BB&T, if you do not have an account with them. When advised of that at the drive-thru window, I said to the teller: REALLY? and took my check back and drove off.

Little did she realize, it was my signature on the check, written by me on behalf of the company, who DID have input as the where the comapny banked.

Two weeks later, the account was closed.

It's a sad, and mildly disturbing story, but who doubts that Mr. Njoku is going to find this a wildly profitable misadventure?
