Honestly, I don't see why a moratorium was necessary to change chemical formulations for the death penalty.

A temporary stay so that states could stockpile the new barbituates, maybe, but this is just ridiculous.

I believe the moratorium is temporary and is in place while the court decides whether the chemicals used need to be changed or not.

I understand WHY it is there.

I just don't think that it was really necessary. Phasing in the new Chems would have worked just as well.

I don't think there is one...

I suspect it's more an issue of the system enacted a methodology that wasn't known / suspected of being flawed before.
I suspect this is part of the mechanism for changing it, although there is a lot of side-issues thrown in.

People who are against the death penalty can be using this as a way of fighting against the death penalty, whereas the actual argument is on the MECHANISM for carrying it out. The actual issue doesn't really include any solid attack against the ideology of capital punishment.
And then people on the other side (for the death penalty) may get swept up in that, rebuffing those against the death penalty when I think the obvious solution is to change the mechanism for carrying out the death penalty, which deflates the issue.

I haven't really seen any arguments for "continuing" as is currently being done, but I haven't looked very hard either ...

Just my two cents worth...

But it is my understanding that no decision has been made to change the chemicals -- that the Court is supposed to decide whether a change is needed.

Am I missing something?

One of the purposes for the "state" to do it is to keep the victims(vigilante justice) from having to do it. If you want the victims to START doing it then stop the state from doing it.

and no I don't mean the ghost will come back, the family and friends are very much victims.



P.S.: Wouldn't it be great if there were ghosts to solve this problem for us?
