But hospitals themselves decide who can visit don't they? They define it or, is there a federal law? What this decision is doing is saying it's up to the patient.

I think it's a combination of policy, hipa laws, and state laws.


I like "it's up to the patient" as it should be....


Get marriage out of government hands and leave it up to the love birds.

I do agree with you there. Make all marriages "civil unions" in the eyes of the government and leave it up to individual faiths, churches or secular organizations to pronounce it "marriage".

Wow. And to think it was already this way 25 years ago when I worked in the Hospital. That's our Government! Courageously addressing the problems of decades past with the resources of today.

What law are you claiming to reference?

I do not believe any such law (for that claimed purpose) ever truly existed.

The actual legal landscape either had state laws requiring partner protection, or the law was silent on the issue of gays, allowing hospitals (and Families) to practice discrimination at a whim.
Or worse, some state DOMAs could easily be interpreted to prevent such hospice recognition.

Furthermore, how is there any system in place for married partners that doesn't also exist for registered domestic partners?
If jane smith comes forward claiming kinship to John smith, what verification is made?
If Jane smith comes forward insisting to make decisions for her claimed husband John, how do you prove whether or not she is current or recently divorced?
