I'm all for personal responsibility but that won't help me one bit when the drunk in the next lane veers into me.
Driving drunk is illegal, as it physically impairs someone's driving ability. Cell phones do not. If cell phones should be banned then food should be banned. I'd venture to say someone trying to eat and drive is more dangerous than using a phone, and add cosmetics to the list as well.

People who are going to be irresponsible will do so whether or not there is a nanny state 'law' against it. There is no need to penalize those who act responsibly.

I want the govt OUT of my life. My freedom of choice is being removed under the guise of 'protecting' me. I don't need or want their nanny-state 'protection'.

I think you are missing the points I've been trying to make. Cell phone use has skyrocketed, and accident numbers have slightly declined. This being the case, are we to believe that all the other previous causes of car accidents have now disappeared or dramatically declined? From the link I posted previously:

Besides that, isn't the NSC federally funded, and isn't it convenient that the numbers from a federally funded (if they are) entity provides supporting evidence that feds need in order to regulate cell phone use in cars?

Talking on a cell phone while driving is more like using a CB radio while driving than drinking & driving.
I understand why texting is more dangerous with the hand-eye coordination & the attention away from road.
However, talking on a cell phone is no greater danger than that of using a CB radio --- I suppose the only difference is that far more people use cell phones today than ever used a CB radio.
Maybe the problem is with the people & not the activity

I actually don't mind government placing restrictions on the privilege of holding a driver's license. Of course, that means the matter shouldn't be a federal one.

Let voter's decide state by state.

I personally don't talk on the phone while driving. I might check to see who it is to see if I need to pull over or if it can wait until I get to my destination, but that's it.

I would never text while driving, but I'm capable of driving a car while talking on the phone.

It's certainly easier to talk on the phone than get a sandwich out of a wrapper and manage a drink as people who eat in cars do.
