Rachel Maddow, Democrats used misleading Barr video to suggest he lied to Congress, reporter finds

MSNBC's "Rachel Maddow Show" and certain congressional Democrats used a misleading video in order to suggest Attorney General William Barr lied to lawmakers, a Washington Free Beacon report found Wednesday.

Maddow played a clip of the exchange between Barr and Sen. Chris Van Hollen, D-Md., from a hearing in early April about Special Counsel Robert Mueller’s report. Her show tweeted out the clip Tuesday night.


In that hearing, Barr replied to Van Hollen that he didn’t know if Mueller agreed with a "conclusion" of his about the report. As Free Beacon reporter Alex Griswold noted, it came after Van Hollen asked Barr about his findings regarding obstruction-of-justice allegations.

"In context, it's obvious Barr wasn't being asked whether Mueller agreed with his ‘conclusion’ meaning his four-page summary, his framing of his facts, etc., but about his ultimate conclusion on obstruction of justice," Griswold wrote.

Mueller had left that question open in the report, which had not yet been publicly released.

It was revealed late Tuesday that Mueller had already expressed frustration to Barr in March about how his findings were portrayed.

Van Hollen called on the attorney general to quit his job Wednesday, saying Barr "totally misled me, the Congress, and the public. He must resign." Congressional Democrats have accused Barr of trying to spin Mueller’s report to favor the president.

Meantime, Maddow asked on her show, "When the attorney general said he doesn't know how Mueller felt about his conclusion, and he says that under oath, is that a problem?" MSNBC did not respond to Fox News' request for comment.

Barr has told members of the House Judiciary Committee that he will not testify before their committee Thursday. Barr appeared Wednesday before the Senate Judiciary Committee.

The saddest part of this whole affair is that I firmly believe that many Liberals KNOW this is just a political game and DON'T CARE....If damaging Trump means lying, cheating, and stealing, then so be it...

That is exactly what is going on. The Democratic party has become a joke. They are acting out like a three old told he can't have that big candy bar in a grocery store and throwing a tantrum in the aisle. They did't get their expected result after demanding that Mueller be allowed to complete his investigation and now they are going after the messenger.

I hope the American voting public sees these people for who they are and votes them out of office at the first opportunity. They are a disgrace to the country. They have taken an institution that was already in the gutter and finding new ways to lower its dignity even further.

In looking at AG Barr's statements I'd ask about the following from Barr's four page summary where he states:

The Special Counsel's decision to describe the facts of his obstruction investigation without reaching any legal conclusions leaves it to the Attorney General to determine whether the conduct described in the report constitutes a crime.
The Mueller Report states the reasons why a determination of criminal conduct was not made while also stating who was to make that determination and it was not left to the Attorney General. Mueller's Report explicitly established, based upon DOJ policy, that only Congress or the Department of Justice after Trump left office could make that determination. The DOJ is restricted to the use of an indictment to allege criminal conduct and cannot make any statement of criminal or even misconduct of a person not under a criminal indictment.

As we can recall former FBI Director James Comey violated DOJ policy when he was critical of Sect of State Hillary Clinton's handling of classified information and in calling that handling "careless" in his announcement that she'd not committed any acts that justified prosecution. The DOJ Inspector General was highly critical of Comey for violating the policy of making statements about an unindicted person.

Robert Mueller and Bob Barr were expressly prohibited from making any statement alleging criminal conduct of the President. The matter did not fall upon the Attorney General that was also prohibited from making any statement that President Trump violated the law.

The Mueller Report also states:

At the same time, if we had confidence after a thorough investigation of the facts that the President clearly did not commit obstruction of justice, we would so state. Based on the facts and the applicable legal standards, we are unable to reach that judgment.
If the evidence establishes that Trump cannot be cleared of obstruction of justice then AG Barr claim that Trump didn't commit obstruction of justice is contradicted by the Mueller Report. Barr, like Mueller, is prohibited by DOJ policy of making a decision that Trump did obstruct justice that can only be made in a criminal indictment.

Next concern.

Over the course of the investigation, the Special Counsel's office engaged in discussions with certain Department officials regarding many of the legal and factual matters at issue in the Special Counsel's obstruction investigation. After reviewing the Special Counsel's final report on these issues; consulting with Department officials, including the Office of Legal Counsel; and applying the principles of federal prosecution that guide our charging decisions, Deputy Attorney General Rod Rosenstein and I have concluded that the evidence developed during the Special Counsel's investigation is not sufficient to establish that the President committed an obstruction-of-justice offense. Our determination was made without regard to, and is not based on, the constitutional considerations that surround the indictment and criminal prosecution of a sitting president.[1]
In this weeks Senate hearing AG Barr was asked if he or Rod Rosenstein or anyone on either of their staffs had reviewed the evidence related to the Obstruction of Justice. AG Barr stated that no one had reviewed the evidence.

How could AG Barr and Deputy AG Rosenstein make a decision on obstruction of justice without ever reviewing the evidence and why did AG Barr falsely claim that their determination was based upon the evidence when he's since stated under oath that they never reviewed the evidence?

While the White House and AG Bob Barr are clearly involved in an effort to obstruct the House investigations of Donald Trump and the Trump administration the allegation made by Speaker Nancy Pelosi seems to leave the House with only one action of recourse.

If, as alleged, Bob Barr did commit perjury the only recourse for the House of Representatives is to initiate impeachment proceedings against Barr. That's the only recourse the House has and, as Pelosi states, "No one is above the law."

"Do you know what they're referencing with that?," he asked Barr.

Barr responded, "No, I don't. I think, I suspect, that they probably wanted more put out."

It was later revealed that Mueller himself had sent a letter expressing his concerns to Barr about his summary.

When Barr was asked why he had testified that he didn't know about the frustrations of Mueller's team after receiving a letter directly, from Mueller, Barr answered in what CNN calls "less than fully forthcoming."

He responded that he did not "know what members (Crist was) talking about and I certainly am not aware of any challenge to the accuracy of the findings."

CNN's fact-checker notes that the standard for perjury is very high, and the two statements from Barr, while not completely in agreement, do not rise to the level of an "actionable lie."

"Is that perjury? Or just fine-tuned spin, by a trained lawyer?" asked CNN's John King.

I watched it as well, live at the time, and can also state that he lied about it. Now there are two witnesses that collaborate each other's testimony. The question was whether he'd had any feedback from the Mueller investigation about his four page summary and we know for a fact now that Mueller had objected vigorously with the mischaracterization of the report by Bob Barr in a letter to Barr.

When Barr is sworn in before a congressional committee the oath is to tell the "truth, the whole truth, and nothing but the truth" and Bob Barr has been evasive and dishonest in his testimony. He's done so explicitly to provide dishonest propaganda material for Donald Trump to use.
