Stealing from the Citizenry: How Government Goons Use Civil Asset Forfeiture to Rob Us Blind

police state?
Published on May 9, 2017
In jolly old England, Robin Hood stole from the rich to give to the poor. In modern-day America, greedy government goons steal from the innocent to give to the corrupt under court- and legislature-sanctioned schemes called civil asset forfeiture. In fact, one year, law enforcement took more stuff from people than burglars did. Police agencies have used their ill-gotten gains to pay for illicit drugs, prostitutes, guns, armored cars, electronic surveillance gear, luxury vehicles, travel and a clown named Sparkles. This is how the American police state continues to get rich: by stealing from the citizenry. It’s a new, twisted form of guilt by association. Only it’s not the citizenry being accused of wrongdoing, just their money. What this adds up to is a paradigm in which Americans no longer have to be guilty to be stripped of their property, rights and liberties. All you have to be is in possession of something the government wants. This is what has become known as “policing for profit.” We are now ruled by a government so consumed with squeezing every last penny out of the population as to be completely unconcerned if essential freedoms are trampled in the process. Our freedoms aren’t just being trampled, however. They’re being eviscerated. At every turn, “we the people” are getting swindled, cheated, conned, robbed, raided, pickpocketed, mugged, deceived, defrauded, double-crossed and fleeced by governmental and corporate shareholders of the American police state out to make a profit at taxpayer expense. Enough is enough.

Nothing can destroy a government more quickly than its failure to observe its own laws, or worse, its disregard of the charter of its own existence.

if the laws are just and
if the Charter is the U.S Constitution, no doubt.

Judge Calls NYPD's Handling Of Precarious Civil Forfeiture Database 'Insane'

Quote:
The New York City Police Department has not bothered to back up data on millions of dollars worth of property it's seized from New Yorkers, a surprised Manhattan Supreme Court Judge learned Tuesday.
"That's insane," Judge Arlene Bluth exclaimed in court, according to Courthouse News.
The revelation, included in a civilian NYPD tech employee's affidavit, reaffirmed concerns that have brewed for years that the NYPD's civil forfeiture process, twice ruled unconstitutional, lacks an accountability system to track, protect, or rightfully return personal property. The NYPD is supposed to return property seized during an arrest once a criminal case ends, so long as the person has a signed release from prosecutors. But public defenders say these requests are often ignored without consequence.
Tuesday's hearing regarded a lawsuit that Bronx Defenders filed last August, in an attempt to force the NYPD to disclose all of the property seized, and how said property is tracked and stored.
"It's not just the property our clients are trying to get back," said Bronx Defenders staff attorney Adam Shoop, of the civil action practice. "It's their entire evidence tracking system. The reason they build it is to track not only what they have to give back to folks, but what they need as evidence in cases. [The judge] was understandably taken aback."
"Particularly given that they spent $25 million to build this," he added.
According to Bronx Defenders, the NYPD ignored multiple formal requests made through the state's Freedom of Information Law. Ultimately, disclosures included an accounting summary from 2013 that noted more than $68 million in seized money from month to month, and a revenue report from 2014. Police said they couldn't find "additional records responsive to the request," according to court papers.

And neither party shows any interest in stopping this...

Why did the USA fight for freedom against the British, Hitler, North Korea, and Saddam if America just ended up as a police state?

All those Americans soldier died in vain.

Cops Took More Property From Americans Than Burglars Did Last Year
...Last year(2014), all of Americaís burglars extracted a total of just $3.9 billion worth of property from their cumulative marks. Pansies, the nationís cops spit in the general direction of that paltry figure. Thatís all you got?
Thatís because over the same period, U.S. law enforcement officials netted $4.5 billion in goods from Americans through a process known as civil asset forfeiture, an astounding figure that economist Martin Armstrong noted on his blog last week in response to an Institute for Justice report.
Consider that for a moment: in 2014, cops took more property from Americans than burglars did....

Cops In Texas Seize Millions By 'Policing for Profit'
https://www.forbes.com/sites/institu...d1a81....These cases can be so baffling, one Texas Supreme Court Justice recently compared civil forfeiture to Alice in Wonderland and the works of Franz Kafka. But civil forfeiture isnít just a quirky curiosityóitís a powerful incentive for law enforcement to take millions...

Seems there's a lot of ROOM for the police to IMPROVE.
seems some cops should be fired or jailed.

as it is this is 3rd world country policing, you get pulled over/visited by the cops and wonder if you'll be robbed by them.

Is civil asset forfeiture ever okay?

Years back, a coworker of mine was arrested and convicted of drunk driving. Since it was a first time offense she was issued a restricted drivers license with limited privilege. For example, travel to and from work, no driving between 8:00pm and 5:00am and zero BAC. Approximately 4 months later she was caught driving at 9:30pm and had a BAC of .09%. Direct violation of allowed travel times and not only alcohol in her system but it also exceeded the legal limit for DWI. She was tried and convicted. The police used civil asset forfeiture, seizing her vehicle and selling it at auction. The vehicle was worth about $15k and she still owed about $11k.

Now, obviously that (true) story is about somebody that was actually tried and convicted for her crimes. Additionally, the asset seized was used to commit her crimes. Different than much of the civil asset forfeiture used by the government to seize assets from "suspects" that have not been tried or convicted and where the assets may have no direct correlation to a crime.

Is civil asset forfeiture ever okay?
