Do some people seriously have marriages where the spouse falls asleep and it's unilaterally okay to have sex with them while they sleep?


The thing that really makes my mind reel is that if a woman thinks it's okay for her husband to do that, then it's not rape. It's her choice to set boundaries with the husband.
BUT, if this item was not included in the legislation, it could be arguably legal even if the woman objected to the sex while she was asleep.
That's what's really going on if they had removed that language.

To me, this reeks of the history involving marital rape where it was NOT legislated as a possible rape scenario. The possibility for a rape to occur between married people didn't start to become illegal until the mid-1970s and it wasn't until 1993 that marital rape was a crime in all 50 states.
