Attorneys for Angela Johnson filed a motion Friday asking for years of data and other documents so they can analyze the racial and gender makeup of grand juries and trial juries in the federal district that covers the northern half of Iowa. They say they intend to challenge the constitutionality of the system, arguing minorities may be underrepresented by the way federal officials create the pool of potential jurors and women could be discriminated against in the selection of forepersons.

“The importance of a representative grand and trial jury to the fair administration of justice cannot be overstated, particularly in a capital case,” they wrote.

Johnson is set to go on trial next year to determine whether she will be sent back to federal death row, where she was the first woman in decades after her original conviction in 2005 on four counts of capital murder. U.S. District Judge Mark Bennett overturned her death sentence last year, ruling that her lawyers failed to present evidence about her mental state that could have convinced jurors to spare her life. Bennett ordered a new trial to determine her sentence, not her guilt or innocence.

That this 8 year old child was hit by a stray bullet, which killed her. So prayers for her, her family and friends.

WICHITA — Wichita police say two suspects are jailed as the investigation continues into a shooting that killed an 8-year-old girl with a stray bullet.

The shooting Tuesday morning in south Wichita killed Kimbra Moore as she slept with her two siblings. A 46-year-old woman suffered a minor wound when she was hit by a stray bullet.

Police say the shooting began with an argument between a man in a stolen car and four other people. One of the four people shot at the car as it drove away. The stolen car was found Wednesday but the driver hasn’t been located.

A 24-year-old man and a 28-year-old man were arrested Tuesday evening. Two others who were detained were later released.

Police say it is still unclear what led to the shooting.

This guy got up on the wrong side of his bed and went out for some pain. Yet it was his & his buddy's choice. We all make them each day many times. Yet most of us make better choice's.

A man who was shot and seriously wounded when he tried to rob a Kansas City, Kan., convenience store pleaded guilty to a federal firearms charge Wednesday, according to a release from the Office of U.S. Attorney Barry Grissom.

Donnell H. Roberson, 25, Kansas City, Kan., pleaded guilty to one count of carrying a firearm while committing a robbery.

In his plea, Roberson admitted that on Jan. 10, 2011, he was one of two men carrying handguns and wearing masks who robbed the Everyday Convenience Store, 6828 Kaw Drive, the release stated.

Roberson was shot as he fled the store. About 30 minutes later, Roberson was admitted to Providence Medical Center with a gunshot wound. Roberson had two collapsed lungs from being shot. One of his lungs was removed at Providence Medical Center, according to the release.

And he made his choice and this is just part of that choice, as he will get time in prison I am sure.

Sentencing is set for Dec. 10. He faces a sentence of not less than seven years and not more than life in federal prison.

Co-defendant Jerome Brown, 22, Kansas City, Kan., pleaded guilty to one count of armed robbery in violation of the Hobbs Act and one count of carrying a firearm during an armed robbery. He is set to be sentenced Dec. 3.

Two people were found dead inside an apartment unit Saturday morning after police responded to a complex when a tenant reported discovering a bullet hole in a wall.

Topeka police were dispatched about 9:30 a.m. to the Pines Apartments, 238 S.W. Gage Blvd., on a vandalism report.

Lt. Ron Gish said a woman called authorities to report she had found a bullet hole in a wall of her apartment. Upon further investigation, Gish said, officers found two people dead in an adjacent apartment unit.

“We don’t know exactly the details,” he said of the circumstances that led to their deaths.

Police did find a bullet hole in an interior wall of the unit the reporting woman lived in, Gish said.

The complex’s location is adjacent to the south property line of what formerly was the Kansas Highway Patrol Troop B Headquarters, 220 S.W. Gage Blvd., which is near Interstate 70.

Few details were being made available to the media, but Gish said he didn’t feel the public should be alarmed that a shooter may be on the loose when asked if that should be a concern. Authorities weren’t saying whether either of the dead people had been shot.

Police also weren’t releasing how their investigation classified the deaths.

The names of the victims were being withheld late Saturday pending positive identification and notification of next of kin. Their gender wasn’t being released.

“It will take time to positively identify them,” Gish said.

Authorities were to hold the scene all night, Gish said. A large white Kansas Bureau of Investigation Crime Scene Unit box truck was parked near the scene. The KBI was assisting Topeka police with the forensics aspect of the investigation.

Speaking in generalities, Gish said sometimes police will ask the KBI to respond to a crime for assistance with such tasks as processing the scene or collecting evidence. He said the KBI specializes in some aspects of forensics that the police department’s own crime scene unit doesn’t.

Several law enforcement officials stood outside the apartment Saturday evening, while some came and went from it.

Police ask anyone with information to call Detective Scott Dickey at 368-9029 or Crime Stoppers at 234-0007.

A man suffering from a gunshot wound walked into a local hospital Saturday night, and officers were attempting to uncover the circumstances surrounding the incident.

Topeka police were notified about 9:30 p.m. that a male gunshot victim had walked into a local hospital. His injuries appeared not to be life-threatening.

Police said the man wasn’t cooperating with authorities. A crime scene hadn’t been identified by police.

The trial of a teenager charged with sexually assaulting a 5-year-old girl during a home break-in was postponed Monday for four months.

The jury trial of Al’Ryon J. Perkins, now 19, of Topeka, was supposed to start on Monday, but the defendant's attorney asked that it be continued to accommodate the schedule of an expert witness.

The crimes occurred Nov. 9, 2010, when Perkins was 17 and the child 5.

One young sick puppy who will know what it is like to be raped once he makes it to prison. I am not hoping this it is just the way things are.

Perkins will be tried starting Jan. 22, and the trial is expected to last five or six days.

Perkins is charged with:

■ Rape of a child younger than 14.

■ Aggravated criminal sodomy of a child younger than 14.

■ Aggravated kidnapping.

■ Aggravated indecent liberties with a child younger than 14.

■ Two counts of aggravated burglary.

Perkins also will be tried on a misdemeanor charge of theft of a cash box containing rare coins and jewelry.

An intruder broke into a southeast Topeka home to steal some marijuana but took a cashbox, then returned to carry the child outside where he sexually assaulted her, police earlier have testified.

Meanwhile, the child's parents and two siblings slept as the intruder twice walked through the residence, witnesses said.

And where were these witnesses when this was going on?

The case of Perkins was moved in April 2011 from juvenile court to adult jurisdiction.

The Kansas Supreme Court on Friday ordered a new trial for a man convicted in Douglas County of second-degree murder, kidnapping and other charges after he found his long-time female companion in the bedroom of another man.

Christopher A. Belone was convicted in March 2007 for the beating death of Linda Begay, who died several days after the beating from complications stemming from a tear in her small bowel.

Before her death on Aug. 1, 2006, Begay told a Lawrence police officer she had been beaten by a table leg Belone wielded after finding her in the bedroom of another resident of the Gaslight Trailer Park in Lawrence. The taped interview was admitted into evidence at Belone’s district court trial, which ended with his conviction and sentence to 586 months imprisonment for the second-degree murder charge, with concurrent sentences for kidnapping and other crimes.

Belone’s attorney argued at trial and again on appeal that the taped interview should not have been admitted because it violated the defendant’s Sixth Amendment right to confront an accuser at trial.

The district court allowed the taped interview as evidence, ruling that Belone had forfeited his right to confront his accuser in killing Begay. A Court of Appeals later ruled the district court had erred in the decision, but upheld Belone’s conviction on the grounds of other “overwhelming” evidence presented in the case.

In a unanimous decision authored by Justice Lee A. Johnson, the Kansas high court said that a United States Supreme Court ruling issued after Belone’s conviction clarified that the “forfeiture by wrongdoing” exception to the confrontation right only applies when the state proves the defendant’s act of wrongdoing was specifically intended to prevent the witness’ testimony.

Obviously, the trial court here did not have the benefit of those decisions and understandably, but surely, applied an incorrect standard,” Johnson wrote. “The State did not show that Belone killed Begay for the purpose of preventing her from testifying at trial. At most, the evidence suggested that the killing was motivated by jealousy.”

Once when Kendra Paine was looking through her former boyfriend's cellphone, she found a photograph of herself laid out on a bed after he belted her in the face, Paine testified Tuesday.

Paine testified for about two hours during the trial in Shawnee County District Court of Travis Brandon Silver, 34, of Topeka, who is charged with felony counts of aggravated kidnapping, aggravated assault, making a criminal threat and interference with law enforcement officers.

Silver also is charged with a misdemeanor charge of criminal damage to property.

Paine testified he kidnapped her, beat her, threatened to disfigure her and terrorized her during a daylong incident March 29 at his home at 424 N.E. Emmett before she was able to call Topeka police and escape.

While she was working her overnight shift at Hallmark, Silver made a pile of her clothes, then poured bleach on them.

On Silver's cellphone, Paine also found a photograph of "someone" holding a bottle of bleach over the clothes before they were damaged, she testified.

How did Paine know her clothes were damaged by bleach? assistant district attorney Dan Dunbar asked.

"Because they look like this," Paine said, propping a jeans-clad leg over the witness stand. The lower leg of the blue denim jeans had large white spots on it.

Paine testified about ongoing turmoil in her life when she cared for her dying mother, the mother's death, the finalization of her divorce — she got partial custody of her three children — and her sometimes tumultuous relationship with Silver.

Early in the Paine-Silver relationship, she referred to him as "my best friend," Paine testified.

That reversed when she sought to reconcile with her former husband because she thought her mother would want that, Paine said.

On March 29, Silver forced her to remain in his home, beat her, forced her to call work to quit a job she loved, and threatened to disfigure her either with battery acid or a torch, Paine said.

Paine said he also held a knife to her neck, used belts to tie her to a chair, used a knife to stab into a wall around her head, stabbed into a mattress she was on, and forced her to go to a motel against her will.

Finally, Silver packed up all the cellphones in his house, then left her while he went to work. Paine called 911 on an old cellphone, and as police arrived, she fled the house when Silver returned home, Paine testified.

The third day of the trial will be Wednesday.

While no violence was used in this case one still has to wonder what else was in the van, even though it was found?

Topeka police are seeking a person who on Friday stole a van containing bio-medical materials from Stormont-Vail Regional Health Center.

Police spokeswoman Kristen Veverka said police responded shortly before 11:30 a.m. to the hospital at 3520 S.W. 6th on the stolen vehicle report.

An employee of the business that owned the van had left a cellphone inside the vehicle. Through an electronic tracking application on the cellphone, police were able to follow the van to Hummer Sports Park, where it had been parked, Veverka said.

Police checked the vehicle but found that the suspect had removed the cellphone from the van after parking the vehicle and took it when he or she fled the scene.

The cellphone was electronically tracked to a driveway in the 600 block of S.W. Oakley, where it had been abandoned, and the suspect had fled the scene.

Police weren’t able to locate the suspect. Anyone with information on this crime may call detectives at 368-9400 or Crime Stoppers at 234-0007.
