If it's illegal, then they should be throwing these thugs in jail. If it's legal, then leave them alone and change the law if it's really that important to them. They should, but religion-based fear is more powerful than law-based fear. Going against religious law can make people fear for their souls, and law-based fear makes them fear for their earthly existence. Like I said, there's a ideological struggle going on between two powerful forces.
