Default Supreme Court to take up Trump appeal in ObamaCare birth control case

Birth control pills are prescription drugs. If it's against your religion to take them don't take them. Your religion does not extend to prevent others from their health care.

Supreme Court to take up Trump appeal in ObamaCare birth control case

Quote:
The Supreme Court on Friday agreed to hear the Trump administration's appeal in a legal fight over religious exemptions for ObamaCare's requirement that employer-based health insurance plans cover birth control.

The administration is seeking to expand exemptions for religious objectors to the Affordable Care Actís so-called contraceptive mandate.

I agree.

You have the right to not pay for medical treatment that is against your religion. People aren't prevented from getting birth control on their own when their employer doesn't cover it.

It's too bad that birth control pills require a prescription. If they were OTC drugs, this issue would be moot.

great point re OCD

The employer often is just the way to cheaper premiums (if you call them cheep ); the employee pays for his own insurance but the employer gets them a rate due to the number of customers the insurer is assured.

And if the employer does provide insurance they must cover certain things because otherwise, the employee is eligible for Obama care.
Again I go back to when 7th day Adventists didn't want blood transfusions (I think that was court settled about a minor? ); an employer cannot withhold that medical procedure just because it is against his religion.

I assume you meant OTC.

The First amendment explicitly enjoins the Federal government from making laws that infringe on the free exercise of religion. By any rational consideration forcing people to violate their religious convictions by requiring they pay insurance premiums for birth control violates this right.

Kindly cite the text in the Constitution and amendments providing an exemption allowing the government to violate the law by forcing employers to buy birth control.

Minor children are under the control of their parents or guardian unlike adult employees.

You missed the point by a mile.

If the ACA requires all entities provide certain things, but violates known religious tenents, and gives exemptions for other aspects, it does not force the entity to the ACA plans. It requires the employee to pay out of pocket for that drug.

Just as any insurance plan has the right to 'tier' prescriptions by their preference, birth control is no different - the insurance plan doesn't have to cover it except by ruling of the ACA. Therefore if it is overturned in favor of the entity, the employee does not have to go to an ACA plan, they just have to pay for their BC out of pocket.

I agree with Lumara, BC should be OTC, it would resolve any number of issues.
