LA sheriff clashes with county lawyer over closing gun shops
 
The LA county sheriff has issued an order closing all gun stores to some 10 million residents.

Sheriff Alex Villanueva said earlier that a “loophole” had allowed gun shops to stay open, and many attracted long lines of customers. Villanueva said the order was meant to keep open gun and ammunition businesses that support police departments and other security organizations.

The stay-at-home order is not a license “for everyone to be panic gun-buying or rushing to stores, which is now what we're seeing," Villanueva said.

He said gun shops have complied and deputies have not had to issue any citations.
The sheriff has "interpreted" the increase in gun buying during the crisis as panic buying and appointed himself as the 2A regulator. The sheriff has ordered other businesses closed as nonessential but appears to be unaware of Constitutional guarantees protecting firearms ownership. :thumbsup

For those insisting universal background checks aren't a means to deny firearms ownership.

Sheriff Alex is lying and he knows it. All the LEO I know were issued their primary weapons and ammunition. Any additional weapons were purchased at conventions and the like at a very severe discount. None were purchased at Bubba's Gun Shop.

Sheriff Nutcase just doesn't like that ordinary citizens can make decisions on their own.

For practical purposes there are no unconstitutional acts regarding the RKBA in California or NJ or NY or MD, states that have no RKBA provision in their state's constitution. The citizens of those states are in limbo until either their state supreme court recognizes a state secured right or a federal court imposes the recognition of the federal right on them. California came this><close with the 9th Circuit's panel decision in Nordyke v King in 2009.

Nordyke v King was a case challenging a town's authority to ban gun shows on public property. It bounced around in the State, Federal District and 9th Circuit for years with the gun rights side losing with the courts citing Hickman v Block, a 9th Circuit case grounded in the theory that the 2nd only protected a right of the states to organize its militia.

Then Heller happened . . .

In light of Heller the 9th Circuit had to allow a new challenge and revisit the case and in light of SCOTUS's individual right holding in Heller, the 9th Circuit panel was forced to rule:

". . . we must first decide whether Heller abrogated Hickman. It did. Hickman rested on our conclusion that the Second Amendment protects only a collective right; Heller squarely overruled such conclusion. . . . Thus the basis for Hickman’s holding has evaporated, and the opinion is clearly irreconcilable with Heller. In such circumstances, we consider our prior decision abrogated by higher authority."

Nordyke v King, (April 20, 2009)

The leftie majority of the 9th couldn't let that stand, if this decision was allowed to become law, pretty much all of California gun control would be struck down. Even worse, this panel also held that the 2nd Amendment was applicable on the states -- understand, McDonald v Chicago hadn't been decided yet!

On request of the state the 9th set this 3 judge panel decision aside and ordered the case reheard en banc (by the full court). That was delayed and delayed while the state worked feverishly to settle the case so the holding would never become law. The case was finally was settled and the Earth-shaking decision was thrown in the legal dustbin.

California remains under the legal shackles of Hickman which means no enforceable individual right to be found in the 2nd Amendment which means the state legislature and governor and duly empowered law enforcement can run amok.

The Second Amendment does not rely on the federal or any state's constitution to exist. That part that states "shall not be infringed" had better constitute a strong warning to any anti-gun ass hole.

There is an organization for everything nowadays. Case in point: a foreign group has organized the club for men with smaller than normal penises. They wished to open a chapter in the United States, but quickly realized we already have the NRA. :shrug

So how do you deride those of the female persuasion who are NRA members or 2A supporters?

Tell me some joke you recently heard about a club for females with some type of feature. Or make it up.


It is my opinion that there will always be people who bleat about how they support the constitution and "most of the amendments", and completely disregard the phrase "shall not be infringed", and they do it while they puff their chests out. Those are the types thinking people in an emergency would not waste their urine on if they were on fire.
