Default Brady Exploitation of "Gun Violence" Victims has a Real Cost $$$

One of the more disgusting practices of the anti-gun left, that of pushing the families of victims of high-profile crimes out in the forefront as pity proxy policy presenters, has victimized a family all over again.

Sandy Phillips tells her story in a Mother Jones article of her and her husband's experience becoming the Brady Campaign's trained show ponies and being prodded to sue a gun shop who sold ammunition to James Holmes, the Aurora theater shooter who killed their daughter among 11 others.

Going on five years after that night the lawsuit they brought against Lucky Gunner has been dismissed and they have been ordered to pay Lucky Gunner's legal fees -- amounting to $200,000.

They have been forced to file for bankruptcy which of course will protect their assets but will in the end, leave Lucky Gunner without their duly awarded reimbursement / restitution.

Did Brady explain to them that under Colorado law they would be on the hook if the suit was thrown out because it violated the Protection of Lawful Commerce in Arms Act and deemed frivolous?

No, and now Brady has run away, leaving the Phillips to twist in the wind . . .

The Brady Campaign are some genuine scumbags.

It matters not who supposedly 'talked you into' filing a lawsuit. You are responsible for your actions.

While I agree that they were likely prodded into the action, and have my condolences for their loss, they still made the choice to file the lawsuit, and in doing so, should have researched the possible repercussions.

And cases like this one is a good start. Brady's virtue signalling is as pointless as it is ineffective.

A few more judgements like this an the pool of willing participants in Brady's political agenda fulfilling legal actions, will evaporate.

In reading the MJ article, I thought this judgement was more recent. Actually it happened 2 years ago so that led me to look for more news.

I found quite a bit of news and commentary and in an article in The Huffington Post, (written by the Phillips), the Phillips' state they were fully aware of the Colorado law that exposed them to paying the legal costs of the defendants.

"Attorneys at Arnold and Porter and the Brady Center to Prevent Gun Violence brought the lawsuit for us, pro bono. We knew the risks of bringing the case. We knew that Colorado and Congress have given special protection of the gun industry, and we knew that under Colorado law we could even be ordered to pay attorneys’ fees because of those special protections."

The sympathy I held for them has diminished and my contempt for the Brady Campaign has grown. It seems that at the outset of the action against Lucky Gunner, Brady was quite willing to take credit for the lawsuit and claim it as their own. The headline on Brady's news release screams:


"Brady Center Sues Online Sellers of Ammunition and Equipment Used in Aurora Movie Theater Massacre"

In that news release Brady brags (emphasis added):

"The Brady Campaign to Prevent Gun Violence recently launched a national campaign against “bad apple” gun dealers, licensed gun dealers that supply the criminal gun market. The campaign commenced with a protest in Chicago, a petition, a code of conduct for responsible gun sales, and lawsuits to hold gun dealers accountable when they turn a blind eye and sell guns to criminals, and the gun traffickers and straw purchasers who supply them."

So lawsuits such as this are a core component of Brady's "national campaign" against "'bad apple' gun dealers", using private citizens as legal figureheads merely because they can be granted standing.

The judge saw right through the charade and said so in his order:

"It is apparent that this case was filed to pursue the political purposes of the Brady Center and, given the failure to present any cognizable legal claim, bringing these defendants into the Colorado court where the prosecution of James Holmes was proceeding appears to be more of an opportunity to propagandize the public and stigmatize the defendants than to obtain a court order which counsel should have known would be outside the authority of this court."

But for Brady's crusade against gun dealers this case would not have been filed. It is their baby; they own the paternal rights and now they are leaving the foster parents open to financial ruin just so they can make ineffective and incorrect political arguments.

I have to wonder if their lawyer told them they didn't have a chance. Because last I checked no one sued Jack Daniels and Ford for a drunk driving accident and won.

No respectable lawyer would tell his client he has a chance. Only bottom-feeding scum suckers would.

You seem to be able to differentiate between bottom-feeding scum suckers and lawyers. I would contend that is most cases, the two terms are synonymous.

Few and far between, but there are lawyers out there who aren't bottom dwelling scum suckers.

I agree. That is why I said "most".

My wife worked for a couple of "good" lawyers for 26 years. They were honest, helpful and fair with their clients. The didn't gouge and would accept far less than their normal rates when the clients could not afford it.

However, they brought in a hot shot lawyer that was nothing less than a crook. Over billed clients, charged them for time he did not work and was basically a slime. Also voted straight Democrat. (I was not even aware of that until recently).

My wife has since left the firm as the other 2 lawyers have since retired.
