Default Gabby Giffords’ Gun Control Group Endorses Two Republican Senators

In an op-ed on CNN Monday, Americans for Responsible Solutions backed Sens. Pat Toomey of Pennsylvania and Mark Kirk of Illinois, who are both facing tough re-election races in a year in which Democrats hope to regain control of the Senate.

The two sitting Senators voted in favor of gun control proposals after the Sandy Hook Elementary School shooting, where 20 children were killed.
“In the wake of the tragedy at Sandy Hook, Republican Sens. Pat Toomey and Mark Kirk broke from the gun lobby and supported a bill to help prevent felons, domestic abusers and the dangerously mentally ill from obtaining firearms at gun shows and online,” wrote Giffords and Kelly in the op-ed.

These things are already against the law. Felons, folks guilty of domestic violence, and the insane are already prohibited from owning or purchasing guns.

April 11, 2017 - After two adults and one student died in a Monday shooting at an elementary school in San Bernardino, Calif., former Arizona Rep. Gabrielle Giffords weighed in, calling for stricter gun legislation, saying, “We can no longer call events like this ‘unimaginable,’ because they happen with alarming frequency.”

The three victims were killed at North Park Elementary School, where the suspect, 53-year-old Cedric Anderson, arrived at the school and opened fire, killing his wife, Karen Elaine Smith, also 53, a teacher, in what police called an apparent murder-suicide. Two students were wounded, one of whom Jonathan Martinez, 8, later succumbed to his injuries, authorities said.

During the previous administration, advocates like Giffords and then-President Barack Obama frequently addressed mass shootings by calling for legislation to curb some people’s ability to buy guns. Such instances included the 2015 shooting in San Bernardino, inspired by the so-called Islamic State, that left 14 people dead.

Giffords’ statement at the time was similar to her comments reacting to this week’s shooting. “Once again, we wish we could use words like ‘unimaginable’ and ‘unthinkable’ to describe this irresponsible inaction — especially as it comes in the wake of yet another horrific mass shooting in our country,” she said along with Kelly. “But we cannot.”

But the sales or transfer of firearms to felons, those guilty of domestic violence, and the "insane" (and ambiguous term at best) by a private party is not illegal unless the person knowingly sells or transfers the firearm and there's generally no way for a private person to know.

Simply making something illegal isn't an effective means of prevention. There must be measures that make it pragmatically possible to prevent the sale/transfer of the firearm as a means of prevention. Today prohibited individuals can purchase firearms from private parties all day long because a private person can't run a background check using the FBI NICS database. Only FFL's (licensed dealers) can run a background check.

One proposal I've not seen offered is to simply open up the FBI NICS database to private individuals so they could do in instant check online. Not a mandatory requirement but simply access. Then make it illegal to sale/transfer a firearm to a prohibited person (based upon the FBI NICS database) because everyone one would have the "means to know" if the person was prohibited.

But it is. Requiring background checks for private sales will serve no purpose, unless you believe that the ghetto corner pimp, drug dealer, firearms dealer will suddenly comply. The fact that most gun crime occurs in gun free locations by those not eligible to possess makes the point.

Background checks are far from perfect and work both ways. Your qualifier notwithstanding. Good people are often denied or delayed in a legal purchase.

Over the years I've transferred dozens of firearms to other people and accepted many from other people. None have been involved in a crime.

Do you seriously want NICS records available to anyone for any reason? Do you really believe that private individuals should be required to maintain those records for 5 years as FFL must do? And last, how much gun crime do you expect this will stop?
