Post Supreme Court Affirms That Even ‘Reckless’ Domestic Abusers Should Lose Gun Rights

Quote:
The Supreme Court ruled in a decision announced Monday that a domestic violence assault committed “recklessly” qualifies as a misdemeanor crime of domestic violence, and therefore triggers the federal ban on gun ownership.

“A person who assaults another recklessly ‘use[s]’ force, no less than one who carries out that same action knowingly or intentionally,” wrote Justice Elena Kagan, who authored the majority opinion. She was joined by Chief Justice John Roberts, as well as Justices Anthony Kennedy, Ruth Bader Ginsburg, Stephen Breyer and Samuel Alito.

The case, Voisine v. United States, was brought by two men who lost their right to own or buy guns after being convicted of domestic violence misdemeanors in the state of Maine.

Under the Lautenberg Amendment, which Congress passed in 1996, individuals convicted of domestic violence misdemeanors can’t legally own or buy guns. But lawyers for the two men argued that their crimes didn’t qualify for the federal gun ban because their assaults were committed “recklessly,” as opposed to knowingly or intentionally.

It’s important to note that reckless acts don’t mean accidental. Under Maine law, a person acts recklessly when he or she “consciously disregards a risk that the person’s conduct will cause such a result.”

The court rejected arguments that the gun ban only applies to intentional acts of abuse.

Careful, don't use the word "rights".

Or better yet, use the word "right" where it actually applies. (like here)

But I get that some people don't understand the difference between how it should be used and what usage is actually b.s.

In retrospect, this could help explain some things. Like all those wasted attempts to get you to understand marriage rights.
Since you didn't understand what a "right" was in the first place and you thought it was interchangeable with "freedom", of course the education was wasted on you...

Marriage rights are a bunch of horse caca if it means also other than heterosexual unions. Let's get that shlt straight before those "rights" are compared to unalienable rights.

Can somebody with more intelligence explain exactly what a "reckless" domestic violence is? The reason I ask is because I picture a husband or wife being told by the baboon in the black robe not to buy or have firearms forever and ever, and so he or she starts carrying a big 16 inch Bowie knife around the waist at all times in the presence of the other.

And a country continues to move on without your agreement...

The info is right there in the article.
And worse case, you could < gasp > look it up yourself!

Some people excel at adding things which have no intelligent merit to actually identifying a solution.

Do you have a proposal for anything different?
Was SCOTUS wrong in saying reckless domestic abusers shouldn't have guns?
Would you want SCOTUS to allow reckless domestic abusers to keep their guns?

Traditional marriage will endure long after we are not even dust. Homo unions (definitely not marriage) have nothing to do with marriage.

I asked with sarcasm when I asked for someone with more intelligence, you understand. I hope.

If you cannot understand the Bowie knife scenario, you're on your own.

Finally, and again with all due respect, I cannot place myself at your, uh, intellectual level, so please excuse my not wanting to discuss certain horse manure. with you. Thank you.

Okay. I'm easy, and I have been known to show mercy, so here goes.

What's next on the gun grabber's agenda? Keep guns away from people who berate the government? Keep guns away from people who curse? Keep guns away from people who spank their children? Keep guns away from people who fart in some person's general direction? My curiosity grows!

My proposal is this: Do your time, and start over again, or forever be guilty. Figure it out, what you think that means.

There is a "sarcasm" emoticon for that.
Regardless, I would bet you still don't get it...

I understood it.
Which is why I replied demonstrating why it was a non-sequitur to the issue at hand.

If I want to discuss horse manure, I know where to go.

Most people who don't want to discuss a topic with somebody simply abstain from hitting the Reply button.
Or maybe you're just doing so "sarcastically".

Well, it didn't take long for you to hit Reply to me again...

How about sticking to the topic at hand instead of trying non-sequiturs of paranoia?

Try answering a simple question, if you have the cajones to be honest...
Do you think Reckless Domestic Abusers should be able to keep their guns?
Yes or No.
Feel free to expound upon the reasoning for your answer, but at least provide a direct yes or no...
