It's not, but $5 tax on a $5 pack of cigs is on a whole different scale from $1000 tax on a $1000 gun. Pretty sure that'll play a factor into a future judicial challenge.

The argument will be made that guns are as big a public health hazard as cigarettes so they should be taxed at the same rate. Our judicial masters have already decreed the Federal government to have virtually unlimited taxing authority in Obamacare to advance the public health, it would be naive to assume they would reject a 100% or more tax rate on gun purchases.

Of course the "unforseen" consequence of a prohibitive tax rate on firearms purchases would be a huge increase in private sales, legal and illegal, leading to surprise, surprise calls for more regulation such as ownership permits, $1,000 or more transfer fees, etc. None of which prohibit gun ownership but just make it at the pleasure of government bureaucrats.

It is a strategy of turning the second amendment into an vestigial ornament one restriction at a time. As noted earlier the exorbitant tax on firearms will expand the underground illegal marketplace providing a platform for more regulation. So-called sensible gun control always rache's towards greater restrictions.
