A West Virginia eighth-grader who was suspended from school for refusing to change his National Rifle Association T-shirt faces up to one year in jail and a $500 fine after being formally charged with obstructing an officer.

Jared Marcum, 14, appeared before a judge Monday and was hit with formal charges that carry a maximum $500 fine and up to a year in jail. The Logan County Police Department initially claimed that Marcum was arrested April 18 for disturbing the education process and obstructing an officer. His father said that officers even went as far as threatening to charge Jared with making terror threats.

"In my view of the facts, Jared didn't do anything wrong," Ben White, Jared's attorney told WTRF. "I think officer Adkins could have done something differently."

Arresting officer James Adkins claimed that Marcum’s refusal to talk obstructed his ability to do his job, while White argued that Adkins never made reference to any violent acts or threats in his petition.

A petition on Change.org calling for charges against the boy to be dropped had nearly 1,000 signatures by Monday afternoon.

Sounds like the arresting officer was clearly in the wrong.
While not to diminish the specific issue involved (gun t-shirt), the charges of "obstructing justice" can be ridiculously trumped up. A catch-all for situations when some bad cops (not all cops are bad) want to use the weight of the law in a situation where they have no right to.

Hopefully this gets thrown out with some punishment for the cop.
I suspect it will just get thrown out, and somebody will have to spend money on a lawyer to accomplish that...

You actually had a Boone's Farm Strawberry Hill shirt at one time? That's reason enough for the Cripes remark, LOL.

Look, we are referring to Middle School, the most unworkable education idea the Baby Boomer generation (ours), ever came up with to destroy the education process. The old Junior HS model worked perfectly well, until we decided to make 6th graders High School freshmen. Kids who would think Che is some Spanish rock star and don't understand how to use a dictionary. If they want to start establishing identities and loyalties in High School, don't care, but down in the Middle School, where nothing but behavior modification is taught, isn't the place for this sort of civil liberties argument. The kids won't understand it anyways, just the adults. Teacher's have a hard enough time with the kids in Middle School, it has driven more teachers out of the education field than anything else. Students there need to be taught, controlled and abide by discipline, otherwise, the ramifications are a mess when they reach High School, and continue to act like Middle School kids, and remain discipline problems. Take the damn shirt off, or turn it inside out, obey what the teacher said, go home and tell Mom or Dad, and if they are so upset about it to push the case further, take their kid out of that school and put him in another. Save the civil liberties arguments for the School Board meetings, or the PTA. It is not a news story, not an adult function to push forward into the public eye. Just clothing yes - but clothing with a message, a "buzz word" message that is very controversial and starts arguments, at least with adults. In this case, the teacher's and administrator's are correct, abide by their decisions. The kid's case is going to get dismissed in juvenile court anyways......Stan

Like so much else this got out of hand from day 1. Now this youth has a criminal record.
For wearing a NRA Tee shirt... this country is getting so bad. Yet in every city of size we have TransNational Dope Gangs.

Now how is that? IMHO this could never happen unless there is some people in high places allowing it.

And they carry Govt., cards as a form of ID.

What would they be arrested and charged with? You're talking about thousands of teachers, although only union member teachers, correct? Any facts?
