Default Biden's upcoming SCOTUS nomination

The news has just been released that Associate Justice Stephen Breyer will retire this coming summer.

President Biden announced last summer that he would replace the next Supreme Court justice to retire with a black female.

This, of course, is just another nod to the practice of identity politics.

Do we suppose that all men think just like all other men?

Why, then, would we imagine that all women would think just like all other women?

And do we suppose that all whites think just like all other whites?

Why, then, would we imagine that all blacks think just like all other blacks?

Does this strike others as just...well, downright weird?

Don't know about weird. But qualification for nomination to the SCOTUS is not about choosing people for immutable acts of birth, but accomplishments in the practice of law and justice. Skin color, sex, and political affiliation are the wrong credentials.

I agree. The racial quotas on the Supreme Court that gave overwhelming preferences to white men for over 200 years have to end.

I guess it goes without saying that the black woman they hire will also be required to have an activist/community organizer type background.

I wonder if judicial experience will be required.

We know he has ruled out white, Asian, and latino women, and all nationalities of men. But where do the gay and Trans people fit in? Who will be representing them?

I mean, according to Democrat thinking, it must be impossible for anyone that isn't gay or trans to judge someone that is gay or trans, right?

All of the women mentioned as being on Biden's short list are judges with significant experience both on the bench and in the courtroom. They are all as or more qualified than any of Trump's Supreme Court nominees.

“While the vice president has the power to cast a tiebreaking vote to pass a bill, the Constitution does not give him [or her] the power to break ties when it comes to the Senate’s “Advice and Consent” role in approving presidential appointments to the Supreme Court,” he wrote.

Asked about his past position on Wednesday, Tribe was regretful, but didn’t back down.

“I wrote that piece around 15 months ago and have not thought about the issue since,” he said in a statement to RealClearPolitics reporter Philip Wegmann. “I doubt that I would reach a new conclusion upon re-examining the matter even though, given the current political circumstances, I obviously wish the situation were otherwise.”
At least, give him credit for keeping his position even though he wished he didn't have to...
