Default Obamacare Survives Latest Supreme Court Challenge

https://www.npr.org/2021/06/17/98883...-supreme-court

The U.S. Supreme Court upheld the Affordable Care Act for the third time on Thursday, leaving in place the broad provisions of the law enacted by Congress in 201o. The vote was 7 to 2.

The opinion was authored by Justice Stephen Breyer who was joined by Chief Justice John Roberts and Justices Clarence Thomas, Sonia Sotomayor, Elena Kagan, Brett Kavanaugh and Amy Coney Barrett. Justices Samuel Alito and Neil Gorsuch dissented.

The Republicans had hoped that after the penalty for not having health care was dropped to zero, it would give the court leave to abolish Obammy Care. But that didn't happen.

The Supreme Court did NOT make their ruling based on the actual case...They simply decided the plaintiffs weren't worthy of making ANY case...

Supreme Court Leaves Affordable Care Act Intact

Quote:
Texas and other Republican-leaning states, backed by the Trump administration, sought to strike down the law on technical arguments after Congress reduced to zero the tax penalty for failing to carry health insurance. Thursday’s 7-2 decision, written by Justice Stephen Breyer, found that none of the plaintiffs suffered any injury from zeroing out the penalty and thus they lacked legal standing to bring the lawsuit at all.

“We do not reach these questions of the Act’s validity,” Justice Breyer wrote. “Texas and the other plaintiffs in this suit lack the standing necessary to raise them.”
See where Justice Breyer EXPLICITLY says “We do not reach these questions of the Act’s validity,”?????...That means it could still be ruled unconstitutional...The majority's ruling was that it was presented by the wrong people...

So you're saying beyond being cruel and shirking their duty to the public trust, Republican politicians who hate obammy care are stupid?
'll drink to that.

seriously, I looked for how the came to the ruling but didn't not find it so thanks for that.

No, the SCOTUS concocted yet another reason to avoid hearing a challenge to the blatantly unconstitutional Obamacare law. The Roberts court continued its hyperpartisan dedication to preserving Obamacare at all costs by using the absurd theory that a zero tax rate harms no one and so there is no standing to challenge the law. Never mind the issue of Obamacare compelling citizens to pay a penalty for not purchasing a private product as an obligation of being alive, Roberts will do anything to please the Democrats.

If the government can deem you need health insurance and force you to buy it, they can deem you need anything and force you to buy the version of that item they think you need, regardless of the realities of the situation as you see it.
Everybody needs a place to live so we are going to pass a law saying you have to buy a home. If you cannot afford a home the government will help you buy one.

Everybody needs transportation, so we will pass a law forcing you to buy car. If you cannot afford to buy a car, the government will help you buy one.

Everybody needs a computer, we will pass a law forcing you to buy one. If you cannot afford a computer the government will help you buy one.
Massive overstep by government. That's my problem with it and I can think of a few reasons why it shouldn't be constitutional.

It isn't Constitutional. And it would not still be law had Roberts not CHANGED it in an effort to find it Constitutional.

The law as passed was NOT Constitutional as the law assigned a financial penalty to those without health insurance. However, Roberts NOT interfered and changed the actual verbiage to change it from a penalty (fine) to a tax, it could not passed Constitutional scrutiny. Therefore, the law that was passed by Congress is NOT the same law being implemented today. Therefore, it is not a Constitutionally passed law and would be thrown out by a Roberts free court.

So when you cannot formulate an intelligent response, you simply attempt to inject your own words into others statements. Classic.

Try addressing the actual subject rather than sniping at a poster, eh?

Why do you believe the plaintiffs had no standing?

All of this simply means that the SCOTUS, under Chief Justice Roberts, set themselves above the constitution, and made law. Performing the simplest Constitutional test exposes the illegality of Roberts ruling on obamacare.

Same Chief Justice who was heard saying, "That SOB will not be President."

Activist Judge Roberts, a Bush appointee, is a disgrace.

As I said in another thread, I believe the Clintons and the Bush's spent 20 years setting our nation up for the failure we enjoy today.
