Default The size of the Supreme Court

Some Democrats are now suggesting that a future Democratic president should pack the Supreme Court with 15 justices. And since the US Constitution does not set a specific number, this change would be theoretically possible.

As an aside, it is rather reminiscent of FDR's court-packing scheme of more than 80 years ago--which was quickly shot down.

There are, of course, some interesting twists here: some have proposed that there should be 10 justices (of the proposed 15) nominated in the old-fashioned way, with the remaining five nominated by unanimous agreement of the other 10 justices.

Others have proposed that there should be rotating SCOTUS justices, taken from the subordinate federal courts; no lifetime appointments.

The bottom line, however, is that all these schemes are designed to counteract the current rightward turn of the High Court.

Ironically, it is precisely when there is a Democratic president--which there will be again, some day--that these "reforms" will be the least useful to Democrats.

Booker and Harris have signed on to a plan with 5 Democrat and 5 Republican justices with 5 more elected by unanimous vote of the other justices.

The justices are supposed to be above politics but the plan calls for openly partisan justices. As we have seen so-called Conservative justices such as Earl Warren or John Robert's reveal themselves to be anything but after confirmation.

Well, no. More specifically, they're designed to counteract the effects of Mitch McConnell stealing a seat on the Court for Trump.

1- Win control of the Senate and Presidency in 2020.
2- Impeach the rapist Kavanaugh and Gorsuch the seat-thief.
3- Replace them with rightful-holder Merrick Garland and centrist Barack Obama.
4- Take SCOTUS to 11 members.
5- Nominate and approve the two youngest progressives who are qualified. Ass tattoos of RBG are a bonus.
6- Restore filibuster rules and blue slip rules for judicial nominations.
7- Giggle as reich-wing morons finally get a taste of majority rule.

The only one you got right was the first point, Win elections. Democrats will win again and I'm sure that they will again control both houses of Congress and the Executive branch (God help us when that happens). At that point, they are free to nominate and confirm any open seats they wish.

However, they should be careful about looking to Impeach Justice's with whom they disagree. The pendulum will always swing back the other way eventually.

As for the seat that was "stolen" from Garland; that is what this country has come to with the hyper-partisan politics we are seeing in this country for that last 20 years. Both sides are at fault on this one. Yes, Garland should have received a hearing. But to hold Gorsuch responsible for that is just being petty.
