Default Justice Ginsburg and her health

Associate (Supreme Court) Justice Ruth Bader Ginsburg deserves our sympathy--and our prayers--as she recovers from cancer surgery; and this, regardless of what her political views may be.

Yet, as I write this, she has missed three consecutive days of oral arguments (today would be the fourth), due to her illness.

If she is simply unable to hear these arguments, then she is unable to do her job; and the honorable thing, it seems to me, would be to step down, and allow herself to be replaced.

It is my understanding, however, that she refuses to do this, as she does not want to be replaced by a Donald Trump appointee.

This, in my opinion--if it is true--is simply dishonorable.

I wish her well and hope she makes a full recovery. While I do not agree with a majority of her opinions, I do not wish the lady any ill and pray for a speedy recovery.

However, I also hope that she is taking time off to recover and fully expects to be back on the court. If she believes otherwise, then she should step down and allow the process to fill that position, proceed.

Well, given that the Court announced today that she's well on her way to recovering from her recent surgery, that there's no sign of any remaining cancer and that she's going to work from home next week (and the fact that she was casting votes on cases from her hospital bed immediately after surgery), this speculation seems rather premature.

(But, that said, even if you are right about her health, I certainly hope that she stays on the Court until the earlier of a Democrat winning the White House or her death, even if she is unable to keep working. After what the Republicans did with the Garland nomination, there's no such thing as "the honorable thing" when it comes to giving Trump another nomination.)

Also agreed...

It all has to do with the prognosis...if she could never do her job again, then hang up the robe...If this is temporary, then let her heal and then put the robe back on and..business as usual...

Oh the hypocrisy, Clarence Thomas is criticized as a dullard for rarely asking questions in oral arguments before the Court but RBG can be absent altogether with no questions of her fitness to continue.

Casting votes from her hospital bed too I'll to discuss the issue being decided just shows that it is politics that drives her decision making not law. She is literally treated like royalty, entitled to her station as long as she is alive, feted in movies and media she can engage in partisan rhetoric attacking Trump during the election with no fear of losing her so-called impartiality.

As with the preposterous notion of the Resistance media being only interested in the facts the claim that the Federal judiciary is above politics is exposed as another Leftist lie by the horror over the prospect of Trump appointing a third SCOTUS justice. It's almost comical to watch some of the same people who straight faced characterize the SCOTUS as apolitical while the likes of RBG legislate a Progressive agenda from the bench bray about the necessity of a Democrat President making further appointments.

The great Garland grievance continues to provide a pretext for any tactic the Resistance chooses to deploy. Never mind that borking is a Democrat invention or the high tech lynching of Clarence Thomas on steroids orchestrated by Democrat Presidential hopefuls, turning the confirmation process into a grotesque carnival is patriotic because Obama didn't get his 3rd appointment, waa.

Thomas and Bork got hearings and votes. If the Republicans had given Garland a hearing and voted the nomination down, it would have been unjustified, but they would at least have done their jobs. Instead, Republicans just stole the Garland seat. Democrats are justified in doing anything and everything legally permissible to prevent another Repubclian nomination.

She's received the transcripts of the oral arguments and is just fine as far as performing her duties as a Supreme Court Justice. She'll continue to fulfill her responsibilities until at least 2021 when the Democrats will control the White House and the Senate (and the House).

She's recovering from the surgery at home and to my knowledge none of the cases she's received the oral argument transcripts on have received any votes from any members of the Supreme Court.
