The interviewee can bring up any subject they like, and IMO, if for any reason they have a 'restriction', it should be made clear once the job offer is made. Then the employer can make 'reasonable accommodation', if it is indeed reasonable.
She brought it up at the interview. She said she would wear a blue jean skirt. Which she did.

I think just about every place I've worked at for my entire life has had some sort of required dress code for the employees. And every one of them had differant dress codes. If you don't like the dress code, go get a job with a differant employer.

No, every situation is different but I think there could have been some negotiation. And a denim skirt I think would have been have fallen under reasonable accommodations.

Why do you think the employer should make reasonable accommodations but the employee should not make reasonable accommodations?

We nurses are allowed to wear jeans on "football Friday" until the season ends.
We have to wear official NFL or team/college t-shirts or the tees we get from work with our logo on it only.
I do sometimes, but not often.

You clearly called out the employer to make accommodations but not the employee to do the same. Double standard?

Does your employer have a dress code?
Mine certainly does.

Heck, my employer even goes so far as to not allow men to wear earrings, not allow anybody to wear ear gauges, not allow men to wear their shirts untucked, not allow women to wear spaghetti strap blouses unless covered with a sweater or other clothing, not allow visible tattoos by anybody, and not allowed to wear facial piercings.
The untucked shirts kind of rubs me the wrong way because I have some nice linen shirts and you never tuck in a linen shirt, but that's the dress code so I suck it up because they pay me well.

Post Re: Religious Waitress Fired For Refusing To Wear Jeans

This thread is kind of amusing in the recognition of how the right often pretend they are the champions for religious freedom, yet here they side with the employer.
And the part where it gets amusing is recognizing that the right has no consistent standard.

The standard used by the courts and the left here is reasonable accommodations
The law requires an employer or other covered entity to reasonably accommodate an employee's religious beliefs or practices, unless doing so would cause more than a minimal burden on the operations of the employer's business. This means an employer may be required to make reasonable adjustments to the work environment that will allow an employee to practice his or her religion.
Denim Jeans => Denim Skirt would be an arguably "reasonable accommodation". We'll see what the courts make of it.

What's not a reasonable accommodation?
Kim Davis trying to claim "religious objection" to doing her job. Where the right sided with Kim Davis.

Actually, I take back what I typed above because the "consistent standard" is whether or not the right wants to sympathize with the religious standard involved.
