The American Press in Times of War

This Week on America & the Courts, the ABA held its annual meeting and a panel discussion on past actions of the American Press during times of war. Examples include: the leaking of the Pentagon Papers, disclosures of the NSA eavesdropping program and whether the press can be susceptible to criminal charges for reporting classified information.

A panel discussion was held on whether the press should be susceptible to criminal charges for reporting classified information in times of war. Topics included the leaking of the Pentagon Papers and disclosures of the National Security Agency (NSA) eavesdropping program.

Floyd Abrams was co-counsel for The New York Times in the Pentagon Papers case. Daniel Ellsberg, former American military analyst, released the Pentagon Papers to the New York Times.

"The American Press in Times of War: From the Pentagon Papers to Iraq" was a program at the American Bar Association 2008 Annual Meeting, held at the Hilton Hotel in New York City.

"The American Press in Times of War: From the Pentagon Papers to Iraq" In light of recent disclosures of the NSA eavesdropping program and secret detainee prisons, can the press be punished for publishing national security information? Join the discussion on whether the American press in times of war should be – under relevant statutes, the Constitution, historical traditions and good public policy – susceptible to criminal charges for reporting classified information.

Post Re: The American Press in Times of War

In "times of war"???

I'm confused...
Are we at war???

Cause the American people aren't asked to sacrifice like in previous wars...
The Bush administration has argued that the detainees aren't "prisoners of war", and their arguments show they don't believe there are ANY "prisoners of war" possible in this conflict...

It would seem that some people want to proclaim "war" when it helps their political purposes, and call it something else when it doesn't suit their needs...
< end sarcasm >

What this boils down to is whether or not the government can act ILLEGALLY and threat actions against the people EXPOSING the government acting illegally...
Seems a LOT like some aspects of "1984" in the double-talk that goes on...
The insistence that the American people ignore the violation on THEIR civil rights, while the government somehow gains an iron curtain that is impenetrable and unquestionable...

Well, we know that Islamic extremists are openly as well as clandestinely at war with us. And we know that we are engaging them in Iraq and Afghanistan.

And tell us how you have been inconvenienced by this supposed rights infringement.

Diminished rights are a threat of continued incursions into American rights. If we permit this to continue, we run the risk of an unstoppable slippery slope.

Values are only real if we are willing to protect and defend them when it's hard. Sacrificing our fundamental beliefs about the rights of man in order to fight individuals who have no respect for the rights of man makes us no better than they are.

Why now but not in previous wars?

I wasn't alive during previous wars, but with my current faith and social beliefs, I would have opposed it then as well. During previous wars we were more concerned with winning than with keeping true to our shared values. When "winning" becomes the answer, whatever you choose to define that as, the rest goes out the window.

I think it's the rest that goes out the window that truly defines us as Americans.

Heaven is in the details. But the Devil is also in the details. *sigh*

Because Obama can't afford to divulge his specifics, why won't you tell us, SPECIFICALLY, what 'rest' is going out the window?

But the Bush administration refuses to acknowledge them as "prisoners of war"...
The Bush administration refuses to take the steps to pass on the war burden to the current U.S. tax-payer.

Why is that?
Is it that they are "at war" with us, but we are just "engaging" in a "police action"?

I would really hope you are not intimating that people's civil rights are only important when they are your own...

We're already seeing that.
The DoJ employs illegal practices in its selection / employment, and it doesn't seem people really care.
Warrantless wiretaps on U.S. citizens, and again it doesn't seem people really care.
The FBI conducts illegal actions on two liberal newspapers, and I think we were lucky we even got to know about it...

Scalia has an "argument" that some torture may not violate "cruel and unusual punishment" on the technicality that it's not meant as a "punishment".

Specifics?

1. American international prestige. We should be leading by example instead of demanding the world cater to our desires.

2. The American Dream. Our failure to ensure a quality economy due to our irresponsible war spending has lessened the chance for most Americans to live the American Dream.

3. Future security. Our focus in Iraq has kept our eye off the ball. We should be fighting a proactive defensive war. Iraq is not accomplishing that goal, in fact many would say that it's contributing to a lack of security.

Those are three to start.
