Yeah, I assume there is an expectation of privacy, sure. However, in the Craig case especially, that expectation was eclipsed by the fact that he was making communications between stalls.

Now I guess you can expect privacy in the stall to have sex if

1) You are a disgusting animal with no control over your base desires.
2) You can perform the activity with enough discretion that you give no indication to others what you are doing.

I would like there to be a positive ruling on expectation of privacy in public restrooms for another reason. Some rest area restrooms are now being built without doors. (There is a brand new one in Louisiana) and with sort of half doors. The people who work maintaining them claim their state builds them this way because of drug addicts shooting up. I told one worker, "If the drug addicts don't mind the sounds coming from my stall, I don't care what they do either!"
And that's just the way I feel about it. There is not enough privacy anywhere anymore especially for travelers.
Also as mentioned about keeping the opposite sex out of your restroom, I have seen couples arguing and one or the other went into a restroom to escape. That ladies or mens room sign was the only thing that kept the opposite party from following. If the ruling is against a reasonable expectation of privacy, then a guy can come into the ladies' restroom and visa versa.
I already have to put up with mothers bringing their 7yr old sons into the ladies rooms!

That's all I'm saying - and all t he ACLU is arguing.

But that's not all they are arguing. They are attempting to expand that reasonable expectation of privacy to acts and behavior that are not acceptable in I guess what you would call "public private areas". I get the gist of their argument; I just find it to be one of their biggest stretches.

Privacy and social acceptability don't always go hand in hand. I don't agree with the ACLU on this one, but it is an interesting test case.

Privacy rights of individuals is pretty universal. Privacy rights of couples in their own home has been protected. Privacy rights of couples in semi-private public areas such as bathrooms? I don't think this has ever been tested in the court system. (Not that I am aware of anyway.)

Well they aren't a bastion of decency themselves...
