May told Eyewitness News they wouldn't let him out of jail for three months until tests proved the so-called drugs were candy.

May said he was just minding his business, driving home from work, when a Kissimmee police officer pulled him over near 192.

"I don't know how it occurred," he said.

May was pulled over for an expired tag on his car. When the officer walked up to him, he noticed something white in May's mouth. May said it was breath mints, but the officer thought it was crack cocaine.

"He took them out of my mouth and put them in a baggy and locked me up [for] possession of cocaine and tampering with evidence," May explained.

The officer claimed he field-tested the evidence and it tested positive for drugs. The officer said he saw May buying drugs while he was stopped at an intersection. He also stated in his report May waived his Miranda rights and voluntarily admitted to buying drugs.

May said that never happened.

"My client never admitted he purchased crack cocaine. Why would he say that?" attorney Adam Sudbury said.

May was thrown in jail and was unable to bond out for three months. He didn't get out until he received a letter from the Florida Department of Law Enforcement and the State Attorney's Office that test results showed no drugs were found.

"While I was sitting in jail I lost my apartment. I lost everything," he said.

While May was behind bars, the Kissimmee Police Department towed his car and auctioned it off. He lost his job and was evicted. Now May is suing the city for false arrest and false imprisonment. He wants to be compensated for the loss of his car and job.

May's attorney and the city of Kissimmee discussed a possible settlement last year, but failed to reach an agreement.

Is this how slow things work in today's justice system?

And I would love to know if the cop had a dash-board camera / microphone. I'm betting not, considering how things played out.

He went to jail for chewing mints.
Perhaps now that he is out, he will make a mint in the lawsuit...

Sorry if I'm stereotyping, but he probably did have coke and covered it up by popping mints.

Hold on. The officer saw the guy buying drugs and the guy first admitted and then denied it. Have you ever known someone to admit to buying drugs when they thought they could get away with it??? Let's take a wild leap here and assume that just maybe the officer is telling the truth and the guy is lieing. You're supporting his efforts to avoid prosecution on a drug possession charge. If he did admit at the scene to haveing the drugs, the field test did show the presence of cocaine (and was accurate), then this drug-user just go tput back on the streets and the people of Florida will be paying his bills and supporting his coke habit for a long time.

Say whaaa?
The officer CLAIMS he saw the guy do some stuff.

The officer CLAIMS that his field test of the MINTS popped positive for cocaine.
That alone should raise some red flags as to credibility...

And at face value, how stupid is it to supposedly HIDE the evidence by swallowing it, and then ADMIT it to the cop???
EXCEPT IT WAS A MINT...

"get away with it"?
How do you "get away" with something BY CONFESSING IT TO A COP???

Have you ever heard of those great dash-cam things the cops have now?
The cop's conversation is recorded, and the suspect is "caught on tape"?
There was a story not too long ago about a group of cops who tried to cover up their buddy cop's traffic accident.
I suspect that if they didn't have the tape, you'd be trying to get that girl convicted too for a crime she never committed.

Let's take a not so wild leap in the area that actually has substantiation.
The mint was not crack cocaine.
It is absurd to think a person would just confess a crime to a cop, especially when he thought he had gotten away with it.

I REALLY wish we had a dash-cam on this, so there would be no confusion. They are really useful in cutting through the b.s.

I am looking at this situation and wondering about the evidence THAT IS MISSING.
This guy supposedly does cocaine? Drug test him.
Nope. They don't do that, do they...

And suppose he had swallowed cocaine and followed up with a mint.
SWALLOWING COCAINE CAN KILL YOU...
Did this guy even get sick in jail? Absolutely no mention of that either...


And taking a step back, have you ever heard the phrase about "ten guilty men going free so an innocent man never goes to jail"?
The level of "reasonable doubt" on this issue (ignoring the evidence to prove police incompetence) obviously sticks this in a "cannot achieve a prosecution" situation.

I stand by my stereo typing. If it was Kissimmee, Fla, probably really was cocaine.
People there will come up to your door to bum cigarettes cause they are supporting their drug habit and can't afford cigarettes.
