Default Supreme Court has voted to overturn abortion rights, draft opinion shows

This is a three-fer...

1) The obvious...It "looks" like Roe v. Wade might be overturned...Nothing is official...

2) This opinion was an obvious leak to outrage the Left into protest...and maybe violence...in order to get justices to change their votes before they become official...

3) A leak like this has never happened before...

Supreme Court has voted to overturn abortion rights, draft opinion shows

Quote:
The Supreme Court has voted to strike down the landmark Roe v. Wade decision, according to an initial draft majority opinion written by Justice Samuel Alito circulated inside the court and obtained by POLITICO.

The draft opinion is a full-throated, unflinching repudiation of the 1973 decision which guaranteed federal constitutional protections of abortion rights and a subsequent 1992 decision – Planned Parenthood v. Casey – that largely maintained the right. “Roe was egregiously wrong from the start,” Alito writes.

“We hold that Roe and Casey must be overruled,” he writes in the document, labeled as the “Opinion of the Court.” “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.”

Deliberations on controversial cases have in the past been fluid. Justices can and sometimes do change their votes as draft opinions circulate and major decisions can be subject to multiple drafts and vote-trading, sometimes until just days before a decision is unveiled. The court’s holding will not be final until it is published, likely in the next two months.

The immediate impact of the ruling as drafted in February would be to end a half-century guarantee of federal constitutional protection of abortion rights and allow each state to decide whether to restrict or ban abortion. It’s unclear if there have been subsequent changes to the draft.

No draft decision in the modern history of the court has been disclosed publicly while a case was still pending. The unprecedented revelation is bound to intensify the debate over what was already the most controversial case on the docket this term.

Unprecedented: Sources Say Justice Roberts Will Call On FBI to Investigate SCOTUS Leak

Quote:
As we reported earlier, the SCOTUS leak regarding the Roe decision is unprecedented in its scope. As political as court appointments have become, there is a professional and moral standard at SCOTUS that has long been held in esteem. Leaks are unheard of because justices and their staff take their judicial mandate extremely seriously. This is the highest court in the land. Their decisions have deep ripple effects throughout American life. They take controversial cases and often make controversial rulings.

For the sake of their own safety, and to protect the draft and opinion process, it is absolutely vital that the privacy of the court be held in tact. Never has there been such a violation of that privacy. Many are calling for an investigation into this leak. Twitter is already pointing to “sources” saying Chief Justice Roberts will likely call for an investigation involving the FBI.

I think the "leak" came from the Democrat party to distract people from the Ohio voting. My opinion.

There are no longer any institutions in this country that are off limits to the left. They are a disease that needs to be eradicated. VOTE THEM OUT!

The leak has 2 objectives, change the focus of the midterms to abortion and mobilize political pressure on Roberts the politician to get Justices to change their votes. The decision was probably not going to be released until after the election but leaking it now is pure partisan politics.

The FBI is going to investigate? If they do it will be like DNC server breech, an intermediary will spoon feed them selected "evidence" that leads to a predetermined conclusion. Naturally there will be leaks confirming the cabal of Evil Republican Justices are plotting to take away all rights from women and minorities.

In debugging software the first place to look is where recent changes have been made including adding new code. Gee, which political activist Justice has been added to the Court recently? From her history as a judge it's clear she follows the ends justify the means philosophy so popular among Democrats. During her confirmation hearings she demonstrated a shocking deficit of knowledge about case law indicating she likely is poorly equipped to sway other Justices to vote her way. She was thrown into a forum with some brilliant legal minds far beyond her ability. But don't worry, if it turns out she is the leaker or authorized the leak she'll be protected.

Can't be...

The last justice appointed was Amy Comey Barrett...

Ketanji Brown Jackson was confirmed, but she's NOT a SCJ...She's taking over when Justice Breyers retires at the end of the current session...

Personally, I don't believe this leak was caused by a Justice...I think this was done by a member of a Justice's staff or an activist posing as a court administrative employee...

SCOTUS Roe v. Wade Leak Is Unprecedented, Analysts Call It An Insurrection.
(Washington, DC) — The leak of a draft opinion from the Supreme Court may be the first breach of its kind. POLITICO published a draft document from the high court showing the conservative majority is preparing to overturn Roe v. Wade. The landmark case guaranteed federal constitutional protections of abortion rights. POLITICO reports that no draft decision has ever been disclosed publicly while a case was still pending. This is not a final decision of record and it’s unclear if the draft will be changed before it is released. Analysts have offered various theories as to why this may have been leaked, including Prof. Alan Dershowitz on Fox suggesting the leak was designed to intimidate the court into upholding Roe. Former White House spokesman Ari Fleischer and former Presidential candidate Mike Huckabee agreed that the leak is tantamount to an insurrection against the court

Yes, but since she was confirmed she may have been informed of the situation.

If she did it, she can say good bye to her appointment.

First let me say, Halleluiah!

Also yes there have been leaks re SCOTUS rulings before this
Quote:
There have indeed been leaks at the court before, albeit of a different scale. One of them actually was about the case at the heart of today's conversation: In 1973, the original Roe decision was leaked to the press before the court had formally announced it.
Quote:
Jonathan Peters, a media law professor at the University of Georgia, noted in a Twitter thread that there were actually two Roe-related leaks in the 1970s.

First, the Washington Post published a story about the court's internal deliberations, including a June 1972 memo from Justice William O. Douglas to his colleagues that was mysteriously leaked.
Seven months later, Time magazine published the final decision and vote details just hours before the court was due to announce it — the result of an early scoop and a delayed ruling.

just thinking out loud here...

with transgenderism and nonbinary and that it's becoming so accepted by society that men can get pregnant that it has even shown up in pop culture with pregnant men emojis...i wonder...???...
do men then also have a right to abortion making it not only a woman's right to choose but a man's right as well?
