At first I thought this could be relegated to a "frivolous" lawsuit.
Your article gives me pause on that thought...

There are some legal filings that can be considered effectively benign. I'm not sure if the SCOTUS request actually means anything regarding the allegation being taken seriously, or if maybe it's more of a form letter response.
It could be that since it has been a "racism" allegation, that all they need is some formal response from Mississippi to consider the issue "closed". 14th amendment history explicitly denotes that racism problems automatically have to meet a higher standard of scrutiny than other potential violations like sexism.

All of the above is pure speculation on my part.
I have no idea how this lawsuit could have any viability to it. I am surprised SCOTUS did that.
