Officer Edward Nero was acquitted on all counts in the arrest and death of Freddie Gray. Why was he even charged to begin with? 4 more trials to go including a retrial.

Baltimore Circuit Judge Barry Williams on Monday rejected the state's case against Officer Edward Nero, acquitting him on all counts for his role in the arrest and death of Freddie Gray.

The judgment, which followed a five-day bench trial, is the first in the closely-watched case. Nero, 30, had faced four misdemeanor charges of second-degree assault, reckless endangerment and two counts of misconduct in office.

Prosecutors argued that Nero committed an assault by detaining Gray without justification, while the reckless endangerment charge related to Nero's role in putting Gray into an arrest wagon without buckling a seat belt. In closing arguments Thursday, Williams had skeptically questioned prosecutors about their theory of assault, which legal experts said was unprecedented.

Williams on Monday said there were "no credible facts" to show that Nero was directly involved in Gray's arrest, and said testimony showed Nero's role in putting Gray in the van was minimized by the actions of others and not unreasonable given his training.

Nero leaned forward after the verdict was read and wiped his eyes. He hugged his attorneys.

Marc Zayon and Allison Levine, Nero's attorneys, said Nero and his family "are elated that this nightmare is finally over."

"The State's Attorney for Baltimore City rushed to charge him, as well as the other five officers, completely disregarding the facts of the case and the applicable law," the attorneys said in a statement. "His hope is that the State's Attorney will re-evaluate the remaining five officers' cases and dismiss their charges. Like Officer Nero, these officers have done nothing wrong."

Prosecutors remain bound by a gag order and did not comment. State's Attorney Marilyn Mosby did not attend the reading of the verdict, and a spokesperson did not respond to questions about her absence.

I believe the cops were patrolling this neighborhood known for drugs. Freddie, a known drug dealer, took off running and was caught. He had an illegal knife and was arrested. Mosby wants to prove that Gray was illegally detained and arrested, and included Officer Nero as responsible. The acquittal was an easy call for the judge. A jury was not chosen in this case.
Since Nero was found blameless in not seat belting Gray, I would think that Miller and Rice would also be innocent of anything to do with seat belts. I guess Mosby has to try and nail the arresting officers, Miller and Rice, on probable cause violations.
The van driver, Goodson, will start his inquisition in a few weeks. Should he have buckled the disruptive and uncooperative Freddie?

CBS took an unsurprising angle on Officer Nero's acquittal proclaiming it's just real hard to convict and rightfully punish a cop. There is an assumption that Nero was guilty and implicated in Gray's death but not provable. It's just so hard to prove says CBS, the deck is stacked. Is that what explains Edward Nero's acquittal?

William Porter and Alicia White have filed defamation charges against Mosby and an official in the sheriff's dept. They probably won't win, but they are pushing back.

Officer Caesar Goodson, the van driver, is now up to bat and the prosecution has been spanked by the judge for not turning over evidence. The trial is still on, however. Mosby wants to prove that Goodson gave Freddie a rough ride and is therefore guilty of depraved heart murder.
So far, there has been 1 acquittal, 1 mistrial, and 5 of the 6 cops have filed lawsuits against Mosby.

As Officer Goodson's trial continues it is worth noting that he has opted for a trial by Judge and not a Baltimore Jury. Mosby is trying to prove the rough ride theory and Goodson was driving.
