She would be prosecuted and personally I think some jail time is in order. She basically stole away the biological father's right to father and she should be punished as severely as a woman who kidnaps a baby from the grocery store. Treat it like that and these cases will be very rare.
Okay, I wasn't clear... I will rephrase...

How would something like that be discovered in the first place?

If she signs the affidavit saying that she doesn't know and gives the baby up for adoption, how would it be discovered that she had been lying?

This case begs the question..
If a woman signs that she is not sure of the paternity, should a guy who can show due cause be able to force her to allow a paternity case? I know if there was a chance that a baby was mine, I would be incensed if I couldn't verify that fact. I know that is a rare situation where a guy might fight for verification of paternity like that, but still...

I don't see why not.

At the same time, it would be a 'he said, she said' situation and no due cause could (most likely) be proven.

If she claims not to know the paternity, I see no issue with any male stepping forward to be tested.
