Well the baby discussed in the OP is a born baby and the judges decided the father wasn't worth squat because he dared to have a one night stand.

Very few cases such as this come up in five moths from initiation. The hgher probablility is that this case was initiated LONG befre the baby was born.

Doesn't matter. In wanting to put the baby up for adoption at birth she is discussing a "born baby." It can't be actually given to anyone for adoption till it is born. The father has a right to be notified that a)he has a baby and b)she's putting it up for adoption so he can go to court to see about his parental rights and a judge can consider whether there is any reason he is unfit.

I agree that on a MORAL level he has that right, but the court has decided that LEGALLY he does not.

I am a very practical person most of the time. I simply to not see the point of making a law that will not work. If there WAS a way to make an enforcible law in this situation, I would be all for it. I believe that the father SHOULD have legal rights when the child is born.

What would be an example of an enforcible law in this situation?

I'm not sure why you think it's not enforcible. If a woman knows who the father is then he must sign off on any adoption. If she doesn't know who the father is then she must sign something saying she doesn't and isn't capable of finding out. I'd imagine those situations were fairly rare. And if she does sign an affidavit asserting she has no knowledge of the father's whereabouts or how to find him and it's later learned that she was lying she should face some sort of consequences.

Honestly, I think that TRUE situations like that would be extremely rare.

I'm just imagining a situation like the one, where she plans to give the baby up for adoption. If she does not want to tell the father, and signs an affidavit, after the adoption takes place what would be a situation where someone would discover that she actually knew?

Yes. True situations where a pregnant woman is completely incapable of notifying the biological father probably are rare. However give women all kinds of options of just "pretending" they can't notify the real father by offering up no consequences for not doing so and these situations will become far more common.

She would be prosecuted and personally I think some jail time is in order. She basically stole away the biological father's right to father and she should be punished as severely as a woman who kidnaps a baby from the grocery store. Treat it like that and these cases will be very rare.
