See I just don't agree since who decides when the child is viable. I have seen babies born as early as 25 weeks survive but ones born at 32 die. The difference in this case I feel is that this man made the choice to kill that child and the mother had no say in the matter to me that is murder. If a person kills the mother with no regard for the child inside her they should be held accountable.

I think that going by the scientific/medical standard would be the only realistic way.

I think that the death of the embryo or fetus should also be punished, but under a different crime than murder. A term like 'malicious fetal death' or such.

No I meant murder was a law and i see that as black and white.Meaning I don't see how one can be one way, and the other different. I didn't mean abortion was murder under current law. Just clearing that up.

But I think this murder was killing both mom and child. Some courts may be squeamish because they don't want that issue cropping up because it's a powder keg for right to life and lawyers talking about precedent. Evidently this court had no such qualms.

Just because a baby dies at 32 weeks and another lives at 25 doesn't mean 32 weeks isn't viable.

Science knows that a child born before 24 weeks has really no chance of survival.

Yes but science progresses everyday so in 10 years babies may be able to survive at much earlier stages.

WRONG! This story is about a man that shot his pregnant girlfriend and he is being charged with 2 counts of murder and I feel he should be. This is NOT about abortion by choice.

Doubtful, unless we can invent an artificial womb.

My nephew is a neo-natal nurse at Fairfax Hospital in Virginia, and takes care of these little ones every day. Any child born before 24 weeks really has no chance, as most of the internal organs are just not mature enough, and no amount of steroids are going to change that.

Fair question.

I believe that those that are already born and surviving are REAL. Those that 'MAY BE born' deserve respect, but are of a different status than thos whop are already here.

Much in the way that I see a resident that is trying to become a citizen in a different way than I see one who is already a citizen.
