Agreed to a point. However, why should we wait for an accident, with injuries and possible death, to demand the phone. I would suggest observation of phone misuse or improper driving while using the phone could be a legitimate cause to impound it.
But the police had better have a dash cam to prove their accusations.
We have got to do something about driving while texting or we will all lose our ability to use the phone in the car all together. Pulling someone over for texting while driving will require proof. Impounding the phone can provide the timeline and proof of texting, not just talking, on the phone. So it works both ways.
