In response to direct questioning from Congress FBI Director Comey clearly stated their investigation of Hillary Clinton's emails uncovered plenty of evidence of illegal activity. Then in complete disregard for the specifications of the applicable statute and prosecutorial practice, Comey proceeded to fabricate a rarities definition of "intent" which he used to give Hillary and staff a pass from prosecution. Claiming the FBI didn’t find any criminal activity on Hillary’s part is nothing but a partisan fairy tale.

I will not belabor each of the many falsehoods in the comment as it appears Hillary will never face criminal prosecution for violating the law. That is not a concession of any of the the gross partisan falsehoods in the comment.

FBI Director Comey testified that violations such as those committed by Hillary should be punished administratively. Clearly denying a security clearance to someone who had directed a long running conspiracy to handle classified documents with extreme carelessness would be appropriate. But Hillary receives classified briefings as a candidate as if she had never demonstrated gross disregard for national security regulations and violated the law with impunity. Others have routinely faced lifetime revocation of their security clearance for far lessor violations but Hillary is above all that.
Once again this is more blatantly false opinion based upon previously debunked claims, allegations, and conspiracy theories. It remains based upon the Republican belief that if you repeat the same debunked lies often enough then stupid people will believe them but the only people stupid enough are other Republicans. 0

FBI Director Comey has never referred to Hillary Clinton's handling of emails as being criminal. The following addresses what FBI Director Comey stated in his Congressional testimony:

Quote:
He also described her handling of classified material as secretary of state as “negligent” — a legal term he avoided using when he announced on Tuesday that “no reasonable prosecutor” would bring a case against her.

The F.B.I. director repeatedly suggested that someone in the federal government who had done what Mrs. Clinton and her aides did would probably be subject to administrative sanctions.

Asked whether those sanctions could include firing or the loss of security clearance, Mr. Comey said that they could. While an F.B.I. employee who mishandled classified evidence in the way that Mrs. Clinton did would not be prosecuted either, he said sternly, “they would face consequences for this.”
The handling of the classified information was unquestionably "negligent" and subject to administrative sanctions but not criminal that would result in prosecution.

The claim being made that Comey referred to Hillary Clinton's "negligent" handling of classified material as Sect. of State as being "criminal" where it would be subjected to criminal prosecution is a "Republican lie" that keeps being repeated and keeps being debunked. Apparently this is based upon the delusional belief that if you tell the same lie enough times it will make it true but it never does.

There were no laws or regulations at the time preventing the use of private email accounts by members of the government and, in fact, the use of private emails servers was widely used by the former Bush Administration that deleted an estimated 22 million "private" emails that senior Bush administration officials, including former Sect of State Colin Powell, that used an unauthorized RNC server.

We can also note that FBI Director Comey directly addressed the statutory requirement for archiving of emails related the person's work for the government and cleared Hillary Clinton, and her lawyers, of any intent to delete emails to avoid the legal requirements for archiving.

Quote:
Comey: I should add here that we found no evidence that any of the additional work-related e-mails were intentionally deleted in an effort to conceal them. Our assessment is that, like many e-mail users, Secretary Clinton periodically deleted e-mails or e-mails were purged from the system when devices were changed.

Not only does this clear Hillary Clinton of an intentional wrongdoing related to the deletion of emails it also disputes the false allegation that there was a "conspiracy" to delete emails for nefarious criminal purposes.

Comey also addressed the unintentional deletion of emails by Clinton's lawyers that could or did have government related business on them.

Quote:
Mr. Comey also criticized Mrs. Clinton’s lawyers for their handling of her emails. He said that they had not actually read all of her emails before destroying them, as she had suggested, and that they may have deleted classified material without her knowledge.
This clears Hillary Clinton of any involvement in, and even knowledge of, government emails that her lawyers unknowingly deleted because (in order to save time and money) they didn't read the actual contents of the emails. Once again no evidence of any conspiracy and no evidence of any criminal intent or action. The accidental deletion of an email with government related content is not a criminal act.

Of course Hillary Clinton would believe her lawyers did read the emails because that's what she paid them to do so that emails that needed to be sent to the State Dept would be sent to the State Dept. Once again this repudiates Republican claims that Hillary Clinton wanted to conceal any of the emails with government related contents because Hillary Clinton had directed her lawyers to actually identify them and turn them over to the State Department in compliance with the archiving requirements.

The lawyers simply failed to do what they were directed to do by Hillary Clinton so some emails that should have gone to the State Department were inadvertently deleted by mistake by her lawyers. While that was obviously careless by Clinton's lawyers it was accidental and not intentional that would make it a criminal act.

I could go on and on in provided direct evidence that all of the Republican allegations are complete BS but all of that evidence has been previously provided and the BS conspiracy theories and unsupported conclusions have been repeatedly debunked.

But the BS continues with statements like, "Each of the more than 2,000 classified emails on the server is incontrovertible evidence of a criminal act"
even though Director Comey has expressly established that they aren't evidence of a criminal act because there was no intent to violate the law nor did the limited number of emails in even a more limited number of email chains, represent gross negligence that would result in it being a prosecutable criminal act.

Repeatedly responding to Republicans that repeatedly bring up the same claims that have been previously debunked based upon facts and the truth becomes really tiring. They don't seem to care about the facts or the truth because they hold to the belief that "If you repeat the same debunked lie often enough then stupid people will ignorantly believe the lie is the truth." Well, they're probably right but that only works with other Republicans. [/quote]
