Is it any different then banning drinking and driving? If a "freedom" causes damage to other people, then is it your right?

I haven't decided how I feel about it at this point, but I get pretty pissed off at oblivious people pulling out in front of me talking on the cell phone.

What do accident stats actually say about this?
