I completely understand what you are saying here, but as several other posters have noted, it doesn't matter if it's legal or not, people are going to smoke pot/drink/take perscription drugs that incapacitate them, and therefore can be the cause of the death of someone.
But so can someone who is lucid, stone cold sober and never touched pot their entire life. Per haps it's cars we should ban? (tongue in cheek)
We will never be able to completely eliminate the danger to others from human beings, or non-human beings, for that fact.
At least it could be another tax revenue source.
