This isn't a war in the sense that it's a state versus a state and so the rules for police actions apply. In that sense, the civilian courts end up sorting a great deal of it out.
YOU keep saying it.
we can't get away with bringing them back to US
So YOU do understand that what Obama wants to do IS WRONG.
Where your "murkiness" befuddles you is the EXTRA CRAP you add to the sentence after it.
"Where" we detain them matters not except for within a State of our Union. Other wise we could not even keep them on a ship or a plane....duh. US possession.

Without a "charge".
Sure just pretend that the soldier that they shot at or set the bombs for didn't have the authority to either kill them or take them prisoner. Pretend that great research was not used to find out "WHO" planned massive attacks or that they did not confess (brag). Why are you so anxious to KILL people that are obviously in no position to do us harm. Suppose they were to "change their hearts" and decide that maybe America is not the big Satan after all?

Excuse me.........you said....

The "rules for police actions"........Simply put, ?????????????????????? WTF are they. Ain't no such animal.
However it is a war of State versus person or persons who are at war against that state. See OUR LAWS do not apply "there" so who's police have jurisdiction? Our court cannot overstep it's authority. Your police analogy does not hold.

An enemy combatant is not determined by law. It is determined by their ACTIONS. Just like with the Barbary Pirates we could seize them, kill them, question them, military court them......anything we wanted to do and guess what they didn't even have a country to ask an ambassador to help them.....just like modern day terrorists. There are actually a great many similarities.
As we kill and capture Somali Pirates are we really going to bring each and every one to America and give them expensive trials, house them for a few years and then release them. Sounds like a life style improvement, they're gonna be lining up.

The Bush/Cheney legal team was and is one of the smartest. They did think this through and you guys have FOUGHT them EVERY step of the way. WHY?
